  • Soon to be Wife

    Hello,

I was looking to get some advice on my current situation. I am a US citizen and my fiancee lives in Dubai. We're getting married in a few months in Dubai and plan on living in SF where I currently work. My fiancee has a valid B2 Visa to enter the US. Her visa is valid for 3 more years. My question is the following, should I wait until we get married, have her enter the US with her B2 visa and then apply for an adjustment of status? Or should I start working on her Fiancee visa? Also how soon before she can start applying for work?

    Thank you in advance

She should not enter on B2 with intent to adjust status; she will be denied entry.

Either she comes on K-1 fiance visa and marry, then do Adjustment of Status, or marry first and she gets a CR-1 immigrant visa. If she comes on an immigrant visa she will immediately be a permanent resident and can work. If she does Adjustment of Status, she should apply for an EAD at the same time and she should get the EAD within 90 days of applying.

This is my personal opinion and is not to be construed as legal advice.
