Not getting FOIA responce from CBP. Need help!

  • Not getting FOIA responce from CBP. Need help!

    My attorney has file FOIA multiple times to get my information from the government. She filed to the CBP agency hopping they would release all the information they have on me.

    It's been over one year since she filed and has got nothing from CBP, other than automated email. My attorney indicated that all they got was an automated email saying that the case-file was closed. They gave her no indication on why they were not going to release anything on me.
    No document or anything indicating they they could not release specific information or why. Therefore I have no basis of appealing the decision. Just case was close and there is nothing to release.

    They called the CBP hot-line but weren't able to get too far.

    I asked, what is she filed separately to USCIS and CBP, she indicated that CBP would have all the information. USCIS doesn't always have all the information.

    Has anyone filed to CBP and USCIS to get a FOIA separately?

    Is "no response" a common response?

    Do they usually give a reason or just ignore and send an "case closed. Nothing to show" automated email?

    Depending on what information your attorney is requesting.
    IE: CBP only has specific information on POE or your I-94, the I-94 can be a stamp in your passport or an individual form or nowadays its electronic.
    If you have your passport # you can now goto: https://i94.cbp.dhs.gov/I94/#/recent-search
    and initiate your own search. If you are like me, who came back in '72 CBP records don't go back that far. So there is no record of me coming over from Canada.
    CBP responded back to me with the same as you: "Case Closed no further info".

    You must be very precise in your request and provide dates, circumstance etc in your request. Processing for FOIA from USCIS was very quick for me and it took 4 months.

    P.S. You don't need a lawyer to make a FOIA request.
