My husband and I sent all of our materials to USCIS November 18, 2015. All of our petitions, his work authorization and his advanced parole were approved within a normal amount of time.
We had our interview on May 16, 2016.
We have heard nothing from them since the interview, if the case was approved or not and it's now December 6, 2016.
According to the field office processing times chart, as of September 30, 2016, our office in Queens, NY was processing applications from February 2016.
We filed an inquiry for case outside of normal processing time on November 16, 2016.
On December 2, 2016 they replied to the inquiry saying the i485 case is still pending and they cannot give a timeframe as to when they will give us a decision.
We scheduled an INFOPASS appointment December 2, 2016 and they couldn't tell us anything.
We wanted to travel out of the US for Christmas to see our families and thought by now we would definitely have an answer. Everyone at USCIS and CBP that we've spoken to about the i512 Advanced Parole says if we leave the US while his case is still pending they can deny him re-entrance if they reach a decision and it's negative while he is out of the country. He is in his first year of the PhD now and would be devastated if he got stuck on the way back into the country. We are going crazy waiting. Does anyone have any advice?
