    hello to all

    i have seen a lot of posts here pertaining the initial evidence requests, but maybe because english isnt my first language i am having a hard time finding answers specific to what is being asked of me,and my husband is just as confused!, i was hoping anyone here could me clarify some doubts:

    we received like 4 days ago a letter requesting initial evidence, more or less everything makes sense to us, except when it comes to the tax information, where they ask for the same thing twice!:


    1 - "The petitioner/sponsor's household member on Form I-864, affidavit of suport, must submit a complete Federal income tax return submitted to the IRS for the most recent tax year."

    the petitioner/sponsor is my husband - we could swear we had submitted all of his tax information with the rest of the documents but we will send it again.

    then they ask :

    2 - "for the intending immigrant´s income (i assume thats me?) to be included in the household income, it must have been from a lawful source and earned while the intending immigrant was authorized to work in the united states.
    the intending immigrant listed on the petitioner/sponsor´s form i-864, or form i-864A, must submit evidence that they are currently authorized (if using current income) or were authorized to work in the united states during the most recent tax year."

    - we only filed i-864, should we have filed i-864a?

    -i have not worked since being here, and have no assets here whatsoever, plus whatever savings i had in my foreign bank account were spent over the past months, partly with this process - so why do they ask this? one of the forms we filled was for my work permit! .....help?!??!

    and then again:

    3 - "the petitioner/sponsor´s household member on form i-864 or i-864A must submit a complete federal income tax return submitted to the irs for the most recent tax year"

    "Submit all supporting tax documentation (W-2s, 1099s, form 2555 and all supporting tax schedules) submitted to the internal revenue service for the most recent tax year".

    we are beyond confused - what are w-2s? my husband has only ever dealt with W-2 and online we couldn't find anything.Are we reading the letter wrong and the s refers to multiple forms?
    form 1099 and form 2555 - he´s never used it. how does he justify that to the uscis? can we send blank forms?

    and then finally:

    4 - "based on the documents submitted with form i-864 for the petitioner/sponsor and household member, the income did not meet 125% of the poverty guideline for the petitioner/sponsors household size.
    submit evidence of assets that meet the standards listed below or obtain a joint sponsor.

    assets must equal the difference between the petitioner/sponsors household size and 125% of the poverty guidelines.

    assets must equal the difference for applicants filling as orphans.
    assets must equal 3 times the difference for a spouse or child of a united states citizen.
    assets must equal 5 times the difference for all others.

    evidence of assets includes:

    bank statement covering the last 12 months or a statement from a bank officer or other institution in which the sponsor has deposits, the account balance averaged over a 12 month period, and current balance.
    evidence of ownership and value of stocks, bonds and certificates of deposit
    evidence of ownership and value/equity of other personal property and dates acquired
    evidence of ownership, a recent licensed appraisal or county tax assessment, and any mortgage/lien or lien release of any real estate."

    then they provide the option of asking for a joint sponsor, but we were hoping to not have to resort to that - dont want to bother anyone else with all this paperwork that is already driving us nuts, unless its the only final option!

    can anyone please us make sense of all this?
    please, any help is very much appreciated - i will put in a letter of recommendation to Santa for all of you!

    (1) Yes send the tax information again.
    (2) This is applicable only if you have income. Since you say you do not, this does not apply to your case.
    (3) Yes, the 's' refers to plural. Your husband definitely needs to submit his W-2. Sometimes, depending on the way you claim your income, you could be getting a 1099 instead of W-2, and hence the listing. Do not need to bother about the other forms, if you do not receive them.
    (4) USCIS wants to see the proof that the household income meets the poverty guidelines. So, if your current household income does not meet this criterion, unfortunately, you would need a joint sponsor. And that party needs to provide the same tax information stuff, etc.

      Sounds like his income alone did not meet the poverty guide lines for a 2 person household. W-2s just means multiple. If you have submitted all tax info: Tax returns and any and all W-2s (plural), and it did not meet the qualifications You all may need to find a co-sponsor. I can not answer any of your other questions. maybe someone else can.
