  • Resubmission of rejected application

    Hello everyone,

    I dont know if anyone has been in this situation before. My application (concurrent filing of I-130 and I-485) was rejected because I did not indicate Application Type on I-485 and the whole package was returned to me.

    I have made the correction but I would like to know if;
    1. I should just send back to USCIS the same package with the corrected form;
    2. Prepare new sets of Forms; or
    3. Return the old package in addition to the new one

    Thank you for your help

    Oh am sorry bro. It takes how many days for them to return it back from the day it was received by them only if you remember? And at the same time I suggest you should just make the correction and send them the corrected form but don't include the mistaked ones cos I don't think it gonna be relevant to them which is why it was returned so the effect one is what matier to them. Just and opinion though.

      You should discard only the form that had a mistake then fill out and put the corrected form. Every other documents should be mailed back including the notice of action and the green letter if any was sent to you. Just from experience.

          Yes.. The notice of action (denial) helps them to determine the reason why your application was rejected.

              Hello please I want to ask how many days does it take them to send you back the application after they received it. And does the rejected application come with the notice of action? Or does it comes back? Thanks in advance.

                It all depends on various factors, especially during this festive season it could take several weeks for you to receive the rejected application and yes the notice of action (rejection) comes along with the application

                  IN ANSWER TO YOUR QUESTION: In Part 2 I-485 check your appropriate box,

                  Review all original applications and backup documents AGAIN before you re-submit.

                  Make a cover letter indicating that you made the correction on the original I-485 and place as the first page of your package and re-submit.
