  • When should I start counting?

    Hey guys,

I'm married to an US citizen and I got my NOA in December's first week. I didn't hear back from them since then. I know it will take awhile and I know that these holidays will delay it more. My question is:
I read that EAD and AP take around 90 days, but is it 90 days after they receive your application or after biometrics? Because I did not get schedule for biometrics yet and I have an international travel on April/2017. I'm afraid to not get my AP until there.

My Priority date: November 22, 2016
    Notice date: December 02,2016
Preference classification: 201 B INA Spouse of USC
    Office: National Benefits Center (NBS)

(which date should I look at??)

Also my last update online on USCIS website was on Dec 7. Message: "Fingerprint fee was received on Dec 2nd"

    Thank you

    RE:When should I start counting?

There is no specific counting period and/or duration. IF you don't get the Request(s) for Initial Evidence, then your EAD and AP combo should be approved/with you after about 1 month from your date of FBI biometrics. Usually that comes 3-4 weeks from your NOA. So my advise to you is to be patient and hope all goes well. So for the mean time you should be getting Notification for Biometrics Appointment pretty soon. By my counting, EAD should be with you in about 60 days or less from priority date (if all goes well) and about 72 days (if you get RFEs). Goodluck once more with your application.

N.B: the holiday won't affect your application process, so do not worry about that.

Cool, I didn't know they don't stop the process in the holiday.

Well, I think will not be here in 60 days, since it's a month already from my priority date and I did not get my notification for biometrics appointment yet. But hopefully I will get it before April so I can travel.

      Thanks for your answer!

          Processing times for EAD/AP

Typical processing time for EAD/AP is 90 days. However you can call and raise "an approaching due date service request" after 75 days. The 90 day period to be counted is from the date mentioned in your Notice. All these are if you do not receive a RFE. In case you recieve a request for initial Evidence, then the clock resets to zero on the date they recieve your reply. If you recieve a request for additional evidence, then the clock merely stops at the date of RFE, and resumes from the date USCIS receives your response.

Just an opinion; Not legal advice.

            Thank you scientist2016.

I did not get a RFE letter, the only I got was about the medical form because I wasn't able to send it together. So as the letter says, I can bring it with me (which I already have on my hands) to the interview.

03/07/2017 - Combo Card received in mail
03/13/2017 - Social Security Card received in mail
08/24/2017 - Interview ready to be scheduled
                08/30/2017 - Interview scheduled for 10/05/2017
                10/05/2017 - Case approved

Your Priority Date. I Received my EAD 91 days from my PD and i also had RFE, So if don't receive any RFE your EAD will the approved between 62 to 75 days from PD.

Cindy, I was in NYC for NYE and just got back on Sunday night. When I checked my mail, the letter was there. I don't know the exactly date I got it since I left home on Dec 29th morning.
