Filling in I-485 form for a visa waiver visitor married a U.S citizen.

  • Filling in I-485 form for a visa waiver visitor married a U.S citizen.

    Hello! I am currently in the process of applying for adjustment of status and while filling in the forms I ran into few confusions. I would greatly appreciate any help from your experience!

    1) I arrived to the U.S on a visa waiver program on November 3rd, 2016 and on December 27th my husband and I got married. Can I select answer a. (An immigrant petition given me an immediately available immigrant visa number that has been approved.) in Part 2. of the form I-485? as my husband is filing a petition I-130 at the same time.

    2) For the part 3 A of the same I-485 form where visa information is requested what can I write as:
    Non immigrant Visa Number - if it's visa waiver do I write N/A or the approval number from ESTA?
    Consulate Where Visa Was Issued - do I write N/A or Electronic System for Travel Authorization?
    And for the Date visa was issued should I write the date I arrived to the U.S or the date I got the approval from ESTA?

    3) For the I-765 form question 16 eligibility category do I just put (c) (9) without any additional description?

    4)As for the filing forms, can we submit the I-130 and I-485 ( with I-765, I-131 and I-864ez) in two hard case binders, with each document placed into clear sheet protectors (basically plastic pockets) with cover letter for each binder and a general Cover Letter for the package?

      You are looking at an old edition of the I-485, which are no longer being accepted. The only edition currently accepted is the 06/26/17 edition (the edition date is on the bottom left of every page). You can the webpage for each form on the USCIS website for which editions are accepted. For I-130 also, only the latest edition is accepted.

      For the corresponding question on the new edition of I-485 about nonimmigrant visa number, just write something like "N/A (visa waiver program)"

      No. Don't use binders or sheet protectors. You can use small fasteners to group each case's documents together.
