Filing I-485 form to adjust status after marriage while on visa waiver program

  • Filing I-485 form to adjust status after marriage while on visa waiver program

    Hello! I am currently in the process of filling in the paperwork for Adjustment of status. My husband a U.S. citizen of birth and I are filing I-130 petition and I-485 forms. During the process of filling the documents I ran into a few confusions and I would greatly appreciate and help with the concerning matters.

    1) I arrived to the U.S on November 3rd, and got married to my husband on December 27th after he proposed on December 17th. Can I select an answer a. (An immigrant petition giving me an immediately available immigrant visa number that has been approved) in the form I-485 Part 2?

    2) In the same I-485 form Part 3, as I arrived on a visa waiver program issued by ESTA what should I write in these questions:

    Non immigrant visa number - should I write N/A or the approval number given by ESTA?
    Consulate where visa was issued - again would it be better to write N/A or Electronic System for Travel Authorization?
    Date visa Issued- should I put the date I arrived in the U.S or the date I was approved for this program(payment acceptance date)?
    If I applied for a Green Card lottery before, should I select that I applied for a permanent resident status or it's a different process?

    3) In the form I -765 Question 16 Eligibility Category, should I just put down (c) (9) without any further explanation?

    4) As for the filing/sending the paperwork, can we submit the forms I-130 and I-485 (with I-765, I-131 and I- 864ez) in hard case binders, with each document placed in a clear sheet protector, with cover letters for each binder?

    Yes, that's what you need to select.

    write something like (N/A - visa waiver program) for all of them

    Only if you've submitted I-485 before

    Not sure about the binders, but otherwise yes
