  • Processing time for Marriage based AOS

I filed an I-130 at the same time my husband filed an I-765 and an I-485 (October 17, 2016). We got his biometrics taken on November 30, 2017. We received a Request for Initial Evidence (sent out December 16th, 2016) for our joint sponsor's proof of U.S. citizenship, even though we had already sent a photocopy of her passport with our original packet. We sent another photocopy of her passport in response to the request, and got a notification on January 6, 2017, that USCIS had received our response. I called USCIS earlier in December and they said I should call back on or after December 31st, when they would be able to give us a full report on our case because it would be past the processing time. I just called today (January 9th, 2017) and they said that the processing time for the I-485 is 10 months!! Everyone else we've talked to has told us start to finish it should be about 5 months, so I don't understand why the USCIS representative said 10 months. She also said that the processing time for the I-765 is shorter: around 75 days. She submitted a work request for us, to my understanding this is when they give us the full update that the USCIS representative I talked to in early December said we could have on December 31st. The woman I talked to today told me that I should wait 15-30 days to hear back about the work request. Why is this taking so much longer than we originally were told? And when can I expect to hear back from them?

Processing timeframes change routinely, and reports of others' timeframes cannot be relied upon. Also, any USCIS staff person's estimate is not something that USCIS staff can guarantee.
