  • Motion to Reopen case I 485 denied

    Guys,
    My best friend filled I485, got a RFE requiring a co-sponsor. She answered and sent co-sponsor W-2 and other documents, but not 1040 and bank statement. Now USCIS denied her case and gave her 30 days to file I 290B (motion do reopen the case). I don't know how to help her and she can't afford a lawyer. We were reading the instructions and looks like easy, but we don't know. Does she needs to send a brief? IS someone here with the same situation or can give us an advise? Please, help us. It is terrible when you can pay a lawyer and she is scared about denied again. it is the last chance. Thanks

    Can you tell what exactly RFE said (maybe post a picture) and your friend replied with?

    And then what does the second notice say in addition to they can file I-290B?

    It is not that complicated to fill the sponsor forms. Make sure to read the instructions and the RFEs/Notices very carefully. Then make sure you include *all* paperwork. You can include a cover letter if you want.

    Paying someone to do it for you may work, or not. There are people who hired lawyers/paralegals and then got RFEs...

      [The first RFE was about the petiotioner didn't have income enough, so they required a co-sponsor. She sent everything from co-sponsor, but the IRS documents, was just W-2. She should send the complete pack from tax return. The second letter was a denied 485 and gave option to file 290B "Motion to Reopen" with 30 days]Can you tell what exactly RFE said (maybe post a picture) and your friend replied with?
