    So its a pretty long story. Me and my husband (USC) lets called him John mailed I-485 and I-130 in Sept 2016. And then they mailed us back in late Sept asking scheduling for finger print. Later on in Nov they mail a letter requesting form I 864 affidavit of support. Mu husband family just started a small business and he is working for them, so thats why he didnt have any W-2 or any tax form. So we mailed his business bank statement and our bank statement (~$20,000) along with a statement saying that my husband is going to take over his parents business soon. Last week, we received a pink letter requesting for initial evidence. The USCIS officer use pen to write it beside the statement:
    " The petitioner/sponsor on I-864 must submit a complete Federal tax return submitted to IRS for the most tax year." 20151040 for John.
    or I can get a co sponsor if John individual income does not meet requirement.

    So the question is am I just mail them back 2015 form 1040? only a year?
    the other thing is my husband is not the name of the business but his parents so there is no way that he can file tax form 1040 ( for self employed only)
    We are planing to file 2016 tax form 1099 instead, do you guys think its gonna be alright?

    And BTW I was working in 2015 under OPT program and I had W-2 , do you guys think its good idea that i mailed my W-2 as well?

    Guys, please help me, I am super frustrated about that...

    You should read the I-864 instructions and the form again carefully. IIRC it asks for most recent tax return mailed, and last 3 years documented in the form itself. You may be able to combine your income by filling out the relevant sections in the form and add your W-2 (if that's what instructions ask for when you combine).

      Hello, thanks for reply me. I understand I need to follow the instruction. But he doesn't have it. I dont know how to prove the USCIS that we are not gonna take any money from government at all. There is no one helping us as a co sponsor at all.... So thats all we can send.

      But the thing is from the pink letter, they wrote down " 20151040 for John " next to the statement "The petitioner/sponsor on I-864 must submit a complete Federal tax return submitted to IRS for the most tax year."

        You have to submit tax return, or you have to provide explanation why you were not and/or are not required to file.

        Then; you have to show you meet the income requirements. If your tax returns show enough, you are done. If not, you can show assets. Assets can be intending immigrant's, or household member's.
