  • Is it too late to apply for Advanced Parole?

    I submitted my I-130,I-485 and I-765 and got accepted in Sept 2016. My I-765 was approved in Dec 2016 and I'm waiting for my interview.
    I want to go back and visit my grandpa this summer because he doesnt have that much time left. I've been in the U.S for 7 years and never leave once.
    During that 7 years,I've lost both grandmas already and now my grandpa is dying. They are very dear to me.
    I want to ask if it is too late to submite I-131 for Advanced Parole now? I heard about the risk of not being able to re-enter but I also saw lots of ppl leaving and re-entering on AP with no prob.
    Should I apply for AP? I really would like to see my grandpa before something happens.

    AP these is taking at least 90 days. So, by the time your AP comes, depending on your processing center you might have your interview scheduled and get your green card. And since you did not apply along with your I485, you would have to pay the fee too.

      This is wrong. It is free no matter if you apply with I-485 or not.

      Yes, you can apply at any time while I-485 is pending for free. It's possible that the I-485 will be approved before you get AP, in which case you won't need APanymore, but you still don't lose anything since it was free.

      Depending on how serious your grandpa's situation is, you may consider either asking for the AP application to be expedited, or, if it is really urgent, to go into your USCIS office and apply for Emergency AP.

        Thanks newacct. As newacct mentioned, since applying for AP is free, I do not see a reason not to do it.

          Thank you so much. Quick question, for the reason, do I just list : ailing grandfather? do they need proof of my grandpa's being sick or anything like that? what kind of documents do I need to include with the application if you don't mind me asking.

            You are not asked to provide a reason for regular AOS-based AP. Are you asking about calling them for expediting or for applying for Emergency AP at the local office?

              I'm asking about regular submission. I dont plan to call for emergency AP cause I won't be able to leave until May since I have school. donyou suggest expediting it? I'm.not sure how the procressing time for AP is now. If i expedite, do I call or there's a different form for expediting? Thank you.
