  • I-130 - Parents became citizens after sister petitioned, Can they petition for me now

    Hello all, I'm in the US currently under DACA for the past 4 years. When my sister became a US citizen through marriage, she petitioned for my parents and I. My parents were approved quickly and became citizens themselves. This was many years ago and obviously the wait time for a sibling is still 10+ years and I have been waiting this whole time. I asked my parents why they never petitioned for me once they became citizens and they always thought it would conflict with the I-130 petition for a sibling that my sister filed for me. Are they correct or am I missing some info? Can my parents not petition for me because they became citizens by being petitioned from my sister? If I understand, the processing time would be much quicker. Thank you for any help!

    What you are describing is the sort of assumption people take without inquiring of a third party credible source, like USCIS or an immigration attorney (the later for a simple courtesy conference).

    Your sister's petition has nothing to do with parents petitioning you, and they should go ahead and submit your petition.

      Thank you very much for your response, Ray. Unfortunately I just looked up the Visa bulletin and for Brothers and Sisters of Adult U.S. Citizens they are currently processing for dates filed before 15MAY97 and for Unmarried Sons and Daughters of U.S. Citizens filed before 22APR95 so I don't think it would have made a difference as I'm still looking at 10+ years. Thanks again.
