adjustment of status for mother, interviewed on Sept 2016, still processing?

  • adjustment of status for mother, interviewed on Sept 2016, still processing?

    so i want to know what people think of this situation and if i can get some ETA based on previous experiences.

    Mother entered with tourist visa in December 2015. Then decided is time to applied for her green card. I, her son, was born here and filed a i485 along with her employment permit. We submitted it in June 20th i believe. We moved fast with the fingerprints and health forms and on August 25th we got an interview notice.
    As far as i know, interview for parents is rare unless there is something they need to clarify something. Anyways, interviewed on sept 24th 2016, and the lady in the interviewed asked her a few questions and seemed to go well. No here is where it gets a bit tricky. Since I submitted her i130 a month prior to her i485, she didnt have the original i130 from the visa something department. I didnt know i could have filed both concurrently and was my mistake but was told that it was no problem, it will only take another 2 weeks for the visa department to send the interviewed my mom's original i130 application (at the time of her interview tho, her i130 was already approved). So she said she can't make a decision unless she gets the i130 which will take 2 weeks from the interview date, after which she will make a decision. Anyways, fast forward to now, it has been 5 months since the interview and the green card is still pending! I was told her green card would arrive sooner but no update after the interview what soever! so i guess im asking, is this a normal timeframe for a parent-i485 who's in the US and had interview ? Any input is welcome

    What "muddied the water" and made this process less predictable was that you did not file the I-130 concurrently and the I-130 was not approved. No matter what the interviewer told you, completion of your mom's process will not be smooth because of the above. And one cannot expect the I-130 approval and the I-485 processing to come together automatically because your processing of the two procedures was not in sync with each other.

    Follow your I-130 progress, and when it is approved, get back in contact with USCIS regarding completion of the I-485 processing.

      Hey thanks for the reply, her i130 was already approved, it got approved BEFORE we sat down for the interview, we even brought the original mail we got with her approval notice for her i130...

        Sounds like mom's Green Card processing and approval is stuck somewhere. Start with an INFOPASS in-person appointment through the following link: https://my.uscis.gov/appointment

        Green Card issuance seems to be a weak USCIS step when anything unusual has entered the picture.

          OMG thank you so much this, i didnt know i can do an in-person appointment. would you happen to know what would i need to bring to the appointment? thanks!

            When you have the time and location of the INFOPASS appointment nailed down, take all immigration-related paperwork with you.
