  • AOS Pending Status

    Hello,
I sent my I-130 and I-485 to uscis and my fingerprint taken.(approximately 6 months ago) So my status considered as aos pending?
Do I still have to keep my F1 status or can I just wait for my green card and spend some time at home? I won't be travelling outside of the states.

There is no such thing as "AOS pending status". You remain in F1 status as long as you continue to meet the terms of that status (i.e. as long as you remain in good standing in school, or if you are on OPT, if you don't exceed the days of unemployment, don't work outside your field, etc.). If you violate the terms of F1 status (e.g. if you stop going to school), you will lose F1 status. But as you have AOS pending, you can remain in the US no matter if you have status or not.

This is my personal opinion and is not to be construed as legal advice.
