  • Visa/i94 expired, have a new approval notice, but haven't left the country

    Hi all,

I entered the country on a P1 visa, which expired at the end of the year. I have an approval notice for a new P1 enabling me to stay in the country - expiry on this is 12/31/17, but this isn't a visa in my passport since I have not left. On I130 when i am asked for my i94 number and expiry date it would look like i have overstayed.

    So a couple of questions:

    1. What is my USCIS Status?
    2. What do I put for "expires on?" question - the new date?
    3. In part 3 - 'Nonimmigrant Visa Number' - Can I use the expired visa number since that's what i entered on?

    General questions
    4. I notice the instructions for this one say leave blank anything that doesnt apply, while other forms say to put N/A or 'none'. Just to double check this is correct and not some old instructions or something?
    5. For my town/city/village of birth - i can just put that? I don't need the country name as well? e.g. London, NOT London, U.K.?
    6. Under Initial evidence - it says passport page with nonimmigrant visa - i include my expired one? I only need the visa page and not the regular passport page?
    7. G-325A - the instructions say to include this. The I-130 instructions also say we should include a G325A for each of us. Does that mean i need 2 copies of mine? 1 accompanying her I130 and 1 accompanying my I-485.
    8. Fees - Filing fee is $1440, Biometrics Fee - $80 - can i add together on one check?

    1. P1
    2. The admit until date on your I-94. Since you got a Change of Status, you got a new paper I-94, with status P1, and a new admit until date. Any previous (paper or electronic) I-94s are invalid.
    3. Yes, the visa you entered on. That has nothing to do with your current status.

    4. Just use common sense. Put none where an answer could be possible but you don't have one. Put N/A where the question is not applicable based on your other answers. If it is very obvious that a particular part is skipped because you selected something in the part right before that allows you to skip it, you could leave it blank.
    5. Not sure what question you are talking about
    6. You only need this if you got it within the last year
    7. yes
    8. Not sure where you are getting this. One check for I-130 which is $535. One check for I-485 which is $1225 ($1140 plus $85 biometrics fee).

This is my personal opinion and is not to be construed as legal advice.
