I'm wondering if I am eligible for filing I-485 and what the next course of action should be, whether I should keep staying in the US. Basically,
- I am here in the US on a B1 visitor visa (initially I planned to be here only for 2 weeks.)
- I currently live in Canada as a permanent resident
- I hold a Vietnamese passport
- My case is supposed to be processed and interviewed in Montreal (my case number starts with MTL)
- Priority Date: 21/06/2010
- Visa Category: F1
- My mother (petitioner) is a US citizen
I just spoke to a friend who said if I file I-485, I can actually keep staying here in the US until my priority date is current (latest visa bulletin info says Jun 1 2010 is current). This means I don't need to go to Montreal to do the rest of the case. Since I am already in the US, and my priority date is less than 1 month away from being current, he said I should stay in US longer than 2 weeks as initially planned, and after I file I-485, I'm legally allowed to stay in the US as a 'in-processing' type of applicant and I can also apply for a work permit and social number.
Is this correct? And if it is so, do you think the best course of action for me is to stay in the US a little longer until my priority date is current and file the I-485?
If this is NOT correct, what would you recommend as my best course of action next?
