  • Traveling within USA with pending change of status

I am planning on traveling within the usa but to a different state. My 1-94 has expired but my Change of Status application is still pending at USCIS. will i get any trouble from boarder patrol or random police checks at any points during my trip? I am planning on carrying my passport and 1-797C (change of status receipt)

It should be fine with the receipt.

This is my personal opinion and is not to be construed as legal advice.

You should be fine with those.
Do you mean I-94? how/why did it expire?
I travel frequently and usually only show my drivers license, though I take passport and 797 just in case, never had any issues.

I mean receipt of I-797, change of status application which is still pending. My I-94 was for six months and i applied for a change of status in good time before the expiration, but now the expiration date is passed but my case is still pending. I don't have a driver's license, i have my passport.

you said border patrol/police check, so you plan to drive to another state? i traveled several times to another state by plane while AOS is pending and i had no problem. they use your ID/Driver license for identification. If you want to be sure, bring your passport but the other two should be enough. I've traveled across states before and there's no border patrol/police check. Arent these located if you cross the border with another country? Anyway, I can tell you for sure if you travel by plane then you'll be fine. As long as you dont leave the US, unless you have AP, then its totally fine.

There are CBP interior checkpoints inside the US, usually within 100 miles of the Mexican border.

I see. I live in TX but nowhere near the border so I wasnt aware. I've always thought border check is located very near to the border. Thanks for letting me know
