  • Tax return

My wife (US Citizen)is about to file her annual tax returns and she wants to file us jointly as a married couple but I do not have a SSN. How does my wife file without my SSN? Is it possible for her to file without including me and not affect my immigration proceedings? Is the ITIN number necessary? If so, how do I get one so I can be included in her tax returns.

If the two of you file as Married Filing Jointly, you need to apply for an ITIN along with submitting the tax return. If she files as Married Filing Separately, you don't have to apply for an ITIN and she can write "NRA" in the space for your SSN/ITIN according to the 1040 instructions.

This is my personal opinion and is not to be construed as legal advice.
