  • Request for Initial Evidence Delays for EAD card

    I applied for I-485 & I-765 on 12/20/2016. I got a request for initial evidence on 1/24/17 and the evidence was accepted on 2/3/17. My question is that is the ROI going to delay the EAD card? will the clock restart from day one starting 2/3/17. I have a job offer waiting and i am worried their patience is going to run out.

    I applied for residency being sponsored by my wife, who is a US citizen. Before this, I was on OPT.

    Here is my timeline:
    12/19/2016: Application Mailed
    12/20/2016: Application Received
    01/03/2017: Checks Cashed
    01/03/2017: Notice of Action Sent
    01/22/2017: Bio-metric Appointment Notice Sent
    01/24/2017: Request for Initial Evidence Sent
    02/03/2017: ROE Response Received
    02/08/2017: Bio-metric scan done

    USCIS says that the clock restarts when an RFIE is sent. does that mean i won't get my EAD until may?

    I believe if it's required of initial document, then the clock starts from when they received the documents. If it's additional documents, the stops when they send out the notice, and resume from the date they received the additional documents.

    So in your case, the clock starts from 2/3/17

      The request was for a copy of my birth certificate in it's original language (even though India provides official birth certificates in 2 languages). My original application had my birth certificate from the official authority in English.
      My lawyer says that it should not delay my application by much. But USCIS says that the clock restarts. i was wondering if anyone has had any experience like this.

        Another December 20th filer and Feb 8 Biometrics date

        Hi

        I was reviewing your post and I've noticed that we have the same PD of Dec 20, 2016 and Biometrics done date of Feb 8, 2017
        My I-485 status is still "fingerprints fees received "
        and I have not received my EAD approval yet.
        Have your got your EAD approval and any update for I-485 ?

          I have the same situation as yours. I filed in all forms and my high school diploma as secondary evidence of DOB (12/7/16). They requested RFE. I sent them photocopy of actual DOB certificate (12/9/16). But my Biometrics were done on 12/12/16 and I received EAD card on 2/10/17. So, my best guess is that your EAD card will come ~90 days after 12/20/2016 which is ~March ending but your interview will be 6 months after the initial evidence response was received.

            Hi! Can you please share what happened? I am on the same boat and would love to hear how much longer after did you recive your EAD. Also what was your processing center?
