  • Help on AOS

    Hello,

    I sent my AOS package to Chicago with the following forms: I-485, I-693, I-765, I-693, 2x G-325a, I-864, I-130 and G-1145.

Also a check of $1225 to Department of Homeland Security (I met up with a USCIS officer in Seattle and he said I could mail all those documents together and that it would cost $1140 + $85 for fingerprints).

The package was received in Chicago lockbox on the 17th of February and I haven't heard from them.

I called USCIS and they did not find any records on my name. The officer told me over the phone that I probably sent something incorrect and they are sending me the package back within the next 30 days, but she can't affirm that because there is no record on her system about me.

I know the fees for the forms separately are different but does anybody know if $1225 should be the correct amount? I don't know what other thing could possibly be wrong...

    Thank you in advance,
    Marcos.
    Marcos.

Did they cash your check yet? $1225 is the right amount though. You also need $535 for form i-130.

They haven't cashed the check. The officer told me over the meeting that $1225 is the full amount when you are sending all these forms concurrently

$535 for I-130 and $1225 for I-485. You didn't attach a fee for I-130 and it will be rejected. The I-485 is based on the I-130 and so it may also be rejected.

This is my personal opinion and is not to be construed as legal advice.

That is so weird! I just talked to an officer on the phone and she said it is correct, when those files are sent concurrently you just pay $1225.

Seriously, I just called them again and now they said even thou I am sending it concurrently it should be $535 + $1225.

Honestly... How unprepared can be a couple agents?? I am so mad... this is going to delay my process more than 1 month.

              FROM THE USCIS WEBSITE :

Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms together. If you choose instead to file Form I-765 and/or Form I-131 separately after July 30, 2007, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of that you filed a Form I-485.

              Our checks for $1225 & $535 were cashed 7 days after the package was delivered (i-130‚ i-485 & i-765)

Did you put 2 checks separately? or can you make just 1 with $1760?

                  Two separate checks

Use this form if you (the petitioner) are a U.S. citizen, lawful permanent resident, or U.S. national and you need to establish your qualifying relationship with an eligible relative (the beneficiary) who wishes to come to or stay in the United States permanently and apply for the Permanent Resident Card (also called a Green Card).

                  $535, effective 12 a.m. Eastern U.S. time, December 23, 2016.

Make sure to read the "Special Instructions" section

Use this form to apply for lawful permanent resident status if you are in the United States.

See the form instructions and Special Instructions for payment details, effective 12 a.m. Eastern U.S. time, December 23, 2016. You must make your check payable to Department of Homeland Security.

Filing fees are in the "Special Instructions" section and are in a table based on your criteria

                  For example

                  Age 14 – 78 : Form Fee = $1140 Biometric Services Fee = $85 TOTAL = $1225

                  So in our case

                  i-130 check for $535
                  i-485 check for $1225

Make sure you read the instructions to make sure the checks are made out correctly (name of the party and NO abbreviations). Check the above links to make sure you have the most current information

Thank you very much for the information.

On the form I-485 they make it clear to make it payable to Department of Homeland Security.

But what about the I-130? I did not read anything, should it be to Department of Homeland Security as well?

I sent out a G-1450 for $1760 for the concurrent filing (1225 + 535) and it was taken off my credit card 1 week after the package was received. It is not just $1225!!
