Greetings,
I'd be grateful if someone had an answer to these 2 questions:
1-
Citizen of African country.
I am H1B currently changing status to GC.
14 years ago, while a student in Europe, i came to US for 2 month internship on J1 visa, with 2 year rule applying.
After internship, i returned to same European country for 6 years, before coming back to US on H1B.
I140 approved, now received RFE for 2 year rule, but i dont have that passport or visa anymore, need to prove that i complied. How can i do that? Note: I spent the time in the European country i resided in for 10 years as a student, not my home country in Africa.
2-
My 3 year old child is H4. Got her H4 visa before entering the US with me in 2013. Traveled back home one year later and got a new visa and I94. Then I did nothing until my first H1B expired in 2016, and i applied for both extensions, which were both approved.
RFE is asking about a gap in child's status, 330 days between 2015 and 2016. I just did not know i needed to extend her H4 independently, assumed my h1b covers her as long as it is valid. Can this gap in status endanger her and my GC. Any ideas what i should do now?
Very very worried !!!
