    Good Morning,

    My husband (applicant) and I (petitioner) completed biometrics on 23 Feb and are in the process of waiting for our interview. What I am trying to figure out is when we can update my husband's drivers license and apply for social security number? Our local immigration office said we should get paperwork in the mail 7-10 days after our biometrics for his drivers license and ssn, but I think we were given the wrong information? For purposes of filing taxes, I want my husband and I to file jointly, but this is causing a delay since he has no valid id. Any help or guidance would be greatly appreciated.

    For most states, he will not be able to get a regular driver's license until he gets his EAD or green card. (In some states there may be special driver's licenses that don't require legal presence documents.)

    He will also not be able to apply for an SSN until he gets his EAD or green card, because he is not authorized to work right now.

    Anyone can (and, if they have non-negligible income, must) file tax returns regardless of their status or whether they have an SSN. Illegal immigrants who work are also required to file taxes. If someone doesn't have an SSN and isn't eligible to get one, they apply for an ITIN together with the filing of the tax return.

      Hi Sarah! I have the same situation. I'm in adjustment of status process and my husband is a US citizen. He filed his taxes by himself after I applied for ITIN number and filed W-7 Form. It takes 11 weeks to get this number (normally it takes 7 weeks but it's peak time right now). He should apply for ITIN number asap because you have to file your taxes jointly and the due is April 15th. In 90 days after your priority day, he'll get his social.
