  • I-130 and I-485 concurrently

    Hello,

I am sending the I-130 concurrently with the I-485 (plus other forms requested by the I-485)

My question is about the G-325a.

The I-130 requires one G-325a for the petitioner and another for the applicant.
And the I-485 requires one G-325a for the applicant

In total should I send 3x G-325a or just 2?

    Thank you.
    Marcos.

One G-325 each should suffice, but the specific form requirements are as you describe (1 each for I-130 and 1 for applicant only for the I-485).

When I do this particular package, I-130 and I-485 together, I follow the 1 and 2 copy (of G-325A) option, as you describe below. It's no extra work, and postage doesn't charge by weight.

Provide each form's required documents independently. So if you are using the old I-130 form to petition a spouse, yes, you would provide two G-325As (one for petitioner, one for beneficiary) for I-130 and one G-325A (for beneficiary) for I-485, for a total of 3 G-325As. Note that if you are using the new edition of the I-130 form, you would not provide any G-325As for I-130; instead the beneficiary would fill out I-130A (a G-325A for the beneficiary is still needed for the I-485).

This is my personal opinion and is not to be construed as legal advice.
