  • Worried About Adjustment of Status Process

    Hi everyone,

I've been reading through online articles and the forums. I feel like my adjustment process is a classic case but at the same time, I'm not so sure. I haven't been able to find anything that answers all my questions so I'm hoping that you can offer me advice or calm me down.

I am on DACA right now and 24. I came to the country over a decade ago with a visa that has expired. Since then, I haven't left. I also have a clean record and never went outside the country. My spouse, a US citizen, and I married recently at city hall. We've been together for 3 years and planned to get married in the future. However, due to the current events, we decided to move in and get married asap and adjust for status now.

I know that the most important thing is making sure the marriage is legit. We have a ton of evidence - hundreds of photos of our vacations, family events, wedding at city hall, proposal, move-in, and just about everything. We also have rings, a joint lease, joint checking account, and can answer just about any question about each other. But,

-Is planning the AOS process before we got married an issue?
-Is marrying earlier to adjust status an issue?
-I also went to San Diego a few years ago for vacation. I was near Mexico so Verizon somehow picked up my signal. Do you think that would cause any issues or am I just paranoid?
-We both went to an Infopass prior to our marriage to get some answers about the adjustment of status procedure. Would a record of that be an issue?
-If we're asked if we planned to adjust status before the marriage at the interview, is it an issue to answer "yes"?
-If we're asked if we expedited our marriage to adjust at the interview, is it an issue to answer "yes"?

Our marriage is legit but to a stranger, we need to prove it. I'm just worried that the above will be potential issues. Is there anything I should be concerned about?

None of the things you mentioned are an issue. It is but natural for people to plan ahead, especially where immigration is concerned, so that should not be a red flag. Answer truthfully to all the questions posed, since if anything a false answer is the biggest no-no. All the best.
Just an opinion; Not legal advice.
