  • New I-130 Form and Misc Questions

    Hello,

    My husband who is the US citizen and I are preparing my AOS packet (I am in the US) but with the new forms we are somewhat confused. We would appreciate any help provided.

    1. I-131 Advance Parole Edited December 23rd, 2016 Part 3 Processing Info: Questions 1 and 2. Date of Intended Departure and Expected Length of Trip. Since Question 1 has calendar option, I cannot type in N/A. What should I put if I am not planning on leaving the country and do not know have the date of Intended Departure.

    2. I used to have EAD cards (OPT) and have A-number which is the same on both cards. But now I am in school and of course, those cards are expired. Can I still use the A-number on my forms?

    3. New I-130 edition February of 2017. p. 3 and 6 about Spouses. It says to list all spouses and start with the most current one. I have put my husband but there is Date Marriage Ended option with the calendar. What do I enter if I am still married and not planning on getting divorced?

    4. p. 7 46d Ask for a date on your I-94. Mine has D/S. But the form only gives you a calendar option. Can I write D/S after I print out the form?

    5. p. 8 I answered 61a-61b by entering the city I live in and US as a country. Was it correct? Should I enter the USCIS where I am sending my AOS packet? I don't quite understand the question. The following 62a-62c, I have no idea what they mean. Does it mean if somehow I decide to file in my home country, where it would be? is it hypothetical question?

    6. Part 9 Additional Information. My husband has extensive employment/Address History information. However, that part asks for page, part and item numbers. I get the page and the part portion, but what about item numbers? For example, page 2 part 2 his address history. Physical address 2 ends with 15b but then next one is Marital Information starts as Question 16. What Item Number do I use for Physical Address 3, 4 and so on?

    You can put Unknown or TBD for both. Write it in if you can't type it.

    The A number on nonimmigrant EADs and the A number for immigration are different; just put none as you don't have one for immigration yet.

    Just put N/A or leave it blank as it would be obvious from the previous questions where you said you're currently married.

    Turn off JavaScript in Adobe Reader and type D/S, or write it in.

    You should enter the USCIS field office that has jurisdiction over your location.

    Put N/A as you are eligible for AOS and doing AOS.

    Not sure. Probably if you put 14 or 15 they will know what the information is for. Use the same item number for additional physical addresses.

      In part 61.a, will it still apply the USCIS field office that has jurisdiction over my location even if I'm submitting it together with the I-485 Form? Or should I put the address I am sending my pack to? Which I think is Chicago. I'm living in Phoenix at the moment.

          Hi- did you ever figure out how to fill this part in? I am struggling as well on what is the correct way.
