  • Question about the I-485 interview

    Hello,

I am applying for a green card through marriage. I am legal in the US and I entered the country in December on a B2 Visa.

I have a Social Security number because 4 years ago I had a work experience in the USA that lasted 4 months (I had a J1 visa).

I am 24 years old now and I just graduated from my University in South America, moved up here and married my boyfriend in January and started the I-485 process in February.

I started working this month on the 1st of March in a restaurant to make some extra money, but I think this isn`t legal. My question is, if they ask me in the interview if I am working should I lie about it?
Or telling them that I`ve been working is not a problem?

I am not comfortable with the idea of not telling the truth but I also don`t want to get my GC denied because of it.

    What is your advise people?

Do not under any circumstances lie to USCIS. That is a great way to have your application rejected. If you do not have a legal EAD, then it is not legal employment. If they ask about this at your interview, be completely honest. Tell them that you thought you would be able to work for XYZ reason and you and your partner really needed the money. Listen carefully to the way they word the question and answer only that question. Example: if you quit your job and they ask "Are you currently employed?" say "No." In the same circumstances if they ask, "Have you had employment since arriving in the States?" you must answer "Yes." Please do not lie.

you should receive your temporary work permit because you even show up to your interview. You should receive it within a couple of weeks after completing your biometrics. But if your interview comes up and they ask you if you worked i would be completely honest.

        Just be honest.

Be honest when they ask you because, they basically know the answer before they asked them and they really have a way to figure things out, so don't complicate it by not telling the truth.

        You can do it,
