  • Problem with the I-864

    Hello,

I received on the mail a letter from the USCIS regarding the form I-864. My husband (US Citizen and my affidavit of support) sent his tax returns from 2014 and 2015 because his 2016 wasn`t ready.

His earning on 2014 and 2015 were below $15.000.

Now USCIS is asking us to send a form 2555 but as I searched this form is for foreign earnings. We do not want to use form 2555.

Can we still sent another I-864 with his tax returns from 2016? In 2016 his earnings were $25.000.

    Thank you in advance.

I am Rober43's husband and I have some follow-up information

    Hello,

I am filing a K-1 for my small business, a 1099, and a W-2. My accountant will not have my return done until the 15th of April. I could potentially get a draft of my return and send it in to the USCIS before filing but I want to make sure I have all income documented. I am at a crossroads because I am not 100% sure that I even meet the poverty line standard of earning from 2016. I earned $25k in 2016 but it is unclear to me what my poverty line amount is considered to be. I believed it to be at roughly $20,025 when I first submitted my documents but now I have doubts.

The letter we received back stated that I have assets that either:
    1) must be equal to three times the difference for a spouse or child of a US citizen
    2) must equal five times the difference for all other

What does this mean the poverty line is in our case?

Should I get a family member to be a joint sponsor?

    Thanks in advance!
