Long story short, my husband was jailed this weekend on some minimal traffic charges, however he is on probation so he may havw to finish his sentence which ends in three months. My interview I suspect will be in two months. What should we do? He is the USC...

Good advice, as appearing without hubby at the interview may result in a denial and loss of I-485 fee, or maybe a possible re-schedule (but don't count on it). Just request a reschedule, with your request on paper and ask fro a paper response.

depending on where you live, the interview can take months. Ive seen a lot of people on here who get the interview after about 6 months to a year. so don't panic, if you happen to get an interview you will have to reschedule. This is exactly what my interview notice says at the bottom...

You must appear for this interview: If an emergency, such as you own illness or a close relative's hospitalization prevents you from appearing, call the U.S. Citizenship and Immigration Services (USCIS) National Customer Service Center at 1-800-375-5283 as soon as possible. Please be advised that rescheduling will delay processing of application/petition, and may require so steps to be repeated. It may also affect your eligibility for other immigration benefits while this application is pending.


Let me explain the last sentence about affecting eligibility for other benefits, what they mean by this is that your I765 (application for work authorization, or Advance Parole (traveling outside of the country while status is pending) may be affected or denied if you reschedule your interview, i hope this helps good luck, i hope he gets out before your interview!

Yes make an infopass early in the morning and take paper documentation of everything, then plead your case very 'respectfully' .
