    Hi all,

    My friend is a US citizen and his girl-friend is a Hong Kong tourist VISA. They been dated for over 10 years and decided to stay with him for good now.

    The 1st thing she think she needs to do is to file the relative petition, so far she knows, I-130 and I485 -_-

    In order to become a US citizen, what is the process flow or guide line that needs to be done please? And thanks in advance guys!!

    Ask him/her to read this



    If the girlfriend wants to move to the USA, they need to get married - else, she can just stay as a visitor (on visitors visa).

    So get a K1 visa, travel to the USA, get married within 90 days while in the USA, and then apply for adjustment of status, get a 2 year conditional green card, remove condition after 2 years, get a 10 year green card, and within 3 years after removing the condition, apply for naturalization.

      Your question is very unclear. What do you mean his girlfriend is a visa? Is she in the US or not? I-485 is for Adjustment of Status which is only for people in the US. There are different processes for people outside the US.

      Also, becoming a citizen is way off and not really relevant right now. She first needs to immigrate (become a permanent resident), and needs to be permanent resident for a certain number of years before she can be eligible to naturalize, but whether she naturalizes or not is her own decision at that point in the future and doesn't really have much effect on her life in the US.

        Thanks guys, their English isn't so good so, well the Girl friend been staying in LA for almost 2 months now, with tourist VISA 180days allowance. They don't want to be sperated again, so they are considering to get married and stay together in the US, happily married after.

        The first things she knows what to do is to get marry of course, then file the adjustment status form which is the I-130 that's all. I would want to summarize what are the forms need to be filed out. As far as I know there are at least 3~4 forms need to be sent out when apply I think.

          So if she wants to stay with her boy friend forever during her visit, how can that be done? Thank you very much
          - She is having B2 VISA 180days allowance; Been stayed in LA almost 2 months now
          - Boy-friend is US citizen; Employee in the US
          - Both dated 10 years

            I-130 and I-485 should be filed together for Adjustment of Status. I-765 for EAD and I-131 for Advance Parole are also recommended to be applied (for free) together with those for ability to work and/or travel in the meantime. Each form requires many accompanying materials and other forms. Make sure to read the instructions. There are some checklists online.

            She should make sure NOT to leave the US until she has Advance Parole or a green card.
