    Hello everyone,

    I came here on f1 visa 3,5 months ago. My boyfriend proposed me 2 weeks ago and we will have wedding in 2 weeks.
    I have read many articles about AOS recently and I really worry. We have many red flags. I am 19 and he is 59. . I am here only 4 months and I am already applying for AOS.

    We really love each other. We have known each other for 1 year and 10 months. We met in my country and we fell in love immediately. He had traveled 2 time to see me (1 month visit, 10 days visit) and I came to visit him in US for 2 months. My family knows him. Then I came to US to study and after 3 months he proposed me on my birthday. I didnt intend to marry him.

    We would like to apply for AOS now because that would allow me to transfer to my dream school and pay in state tuition. But I worry... Will we have problems with USCIS?

    Yeah the age difference is a pretty big red flag.

      It sounds as if your plans are to go to school in the US and not necessarily to get married to your soon to be husband. But, in order for you to pay less tuition, you're getting married. Why not pay more for school and study something that will allow you to immigrate independently on an employer based visa.

      If you follow the current route, you may be denied based on the above red flags.

        If you intend to be married, you will ultimately be able to get over the age-gap red flags. It won't be easy, but we don't choose our spouses based on how difficult the immigration journey is

          sorry to hijack your thread but let me ask our senior members if 9 years age gap is a red flag?

          our I-485 and I-130 status is still "fingerprint fee was received/case was received" but EAD/AP already approved. our PD is 12/23/16.

          and now im worried after seeing this thread because we only sent our apartment lease as proof together with the application.
          but we can provide proofs in the actual interview.

            The only reason why I thought the age difference is a red flag was when it is combined with the other information provided by the OP. Granted a 10 year age gap is much more common than 40.

              I'm on the same boat, I am also applying my AOS. Base on what I read in this forum. Some of the member here that applying for AOS they brought there proofs during the interview.
              You're lucky because you have already your EAD/AP approved.
              Did you got approved with your EAD without RFE?

                Yes, I received my EAD without any RFE. Made 1 Service Request on 91st day then after a few days, it's approved.

                Just worried with our I-485 and I-131, most people have their status changed to "Ready to be Scheduled" in less than 2 months after submission. Ours will be 4 months on the 23rd.

                  Rather than worry about a RFE or NOID that has not happened yet, and may never happen, I would suggest you all focus on nurturing your relationships, building your lives together, and accumulating evidence

                    Don't Worry about your status change, Mine never did, from RFE response received it went straight to interview has been schedule dated after 8 months. You will be alright.

                          Age may be a flag but it is not legal grounds for denial; you just live out your relationship and when the interview is here attend it in full confidence. Our president had 3 wives, his current could be called a "trophy wife"; who is there to question love?
