  • Birth certificate name issues (marriage based AOS)

    Hi All,
I am currently on L1B status and have been so for the last 4 odd years. I and my fiancee who is USC are due to get married in a month's time, and subsequently apply for my AOS (concurrent 130, 485).
We are planning on collating the documentation required in the next month or so, so that we can file the application shortly after our wedding day. I went through the documentation required to file 485 and 130 yesterday in detail. I have a situation related to my birth certificate and it is as follows:

    1. I was born in India and my birth was registered 2 days after I was born. The BC is in my native language (strangely the answers by registrar of births on birth certificate are in native language. The form, itself is in english).
    2. My name on birth certificate is in eastern name order. There fore it is written as <myLastname><myFirstname> (Eastern name order has no comma between them as is the norm in western name order while writing last name first)
    3. My name in passport is <myFirstname><myLastname> (proper western name order)
    4. I ofcourse need to get it translated. My understanding is translator will do an 'As-Is' translation and would not obviously change the name order to western name order
    .

Question1: Is this a case for RFE ? If yes, what remedies should I take (additional documentation etc) as part of application submission to reduce RFE incidence.

    5. My father's name on my birth certificate is also in Eastern name order - <myFather's_Lastname><myFather's_Firstname>. The good part is his name is also in the same order in father's name field on my passport (that is same order as on Birth certificate).

Question 2: Which naming order should I write my father's name in 'Father's name' section on forms like 325, 485 etc ? By the way, this question also applies to marriage license where father's details have to be entered and the subsequent marriage certificate which is an important document for 485 will have that.
