Hi Immihelp Experts,
I arrived to the states under L1 visa back in March 2014, shortly after my wife's arrival back in October 2013 under LPR status.
My wife and I got married in January 2015, and filed an I-130 to USCIS back in March 2015.
Back in August 2016 my priority became current and we filed the I-485 package along with both EAD and AP applications.
However we did not have any feedback from USCIS/MSC office after 90 days (Nov 2016), so we decided to call USCIS lockbox.
She stated that the case was rejected due to priority date was not current, and they did sent back the whole package. (Which we did not receive and still lost to this date by USPS)
However, I did mention to the lockbox representative that the priority date was current according to USCIS website. She confirmed the date and asked us to resubmit the whole package again.
In January 2017, I went ahead and attended the fingerprint appointment and received a combo EAD card in March 2017.
The interview is scheduled this week.
However, my spouse quit her job back in September since she got pregnant (Due Date in May 2017) and I forgot to amend the I-864 before sending the whole package back to USCIS again back in November 2017.
So obviously the information on the I-864 is incorrect and she is no longer eligible to sponsor me.
I am currently working under my EAD (L1 status expired on March 2017), and is listed as a joint sponsor on my I-864.
My current earning is more than 4 times the poverty 125% line for a 3 people household.
Would this cause a major complication to my application? And do I need to fill out a new I-864 to bring to the interview?
