  • Need help to know aboout renewal of EAD.

    Hi,
    Good morning.

    Can anyone help me to provide some information about renewal of EAD?

    How much should I pay for filing fee? is the same as regular one?
    WHat's the process I need to follow? Can I apply by myself? My attorney asking $350 to prepare that? Is that such difficult to do that as I have already EAD exists.

    Anyone recently applied for EAD renewal , can you please share your experience .

    On what basis was your current EAD issued?

    There is no process to renew an EAD per se, you go through the same steps (and have the same burden of proving eligibility) as applying for an EAD in the first place

      Its marriage based. My US citizen husband applied for me . My EAD will expire on 8/15/17. Waiting for interview . DD : 27 July 16 and Field : Saint Paul , MN.

        If you are EAD Applicant Who Have Filed for Adjustment of Status (I-485)...

        Renewal EAD. If this is a renewal application and you are applying under one of the following categories, a filing fee is
        not required:
        1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
        2. (a)(10) Granted Withholding of Deportation;
        3. (c)(l), (c)(4), or (c)(7) Dependent of certain foreign government, international organization, or NATO personnel;
        4. (c)(9) or (c)(16) Adjustment applicant who applied after July 30, 2007.

        And you are (c)(9). So no fee for renewal. I'm getting ready to reapply myself. It shouldn't be difficult.

            My Attorney. He asked a lot of papers I just provided to him. I am not specific what exactly needed for EAD filing. Is that you were asking?

              Ok, so here's what you need to file:

              1. form I-795 ( download it from https://www.uscis.gov/i-765)
              2. a copy of you last EAD card (front and back)
              3. You must submit two identical color photographs of yourself taken within 30 days of filing your application.
              The photos must have a white to off-white background, be printed on thin paper with a glossy finish, and be
              unmounted and unretouched.
              The passport-style photos must be 2” by 2”. The photos must be in color with full face, frontal view on a white
              to off-white background. Head height should measure 1” to 1 3/8” from top to bottom of chin, and eye height
              is between 1 1/8’ to 1 3/8” from bottom of photo. Your head must be bare unless you are wearing headwear as
              required by a religious order of which you are a member. Using pencil or felt pen, lightly print your name and
              Alien Receipt Number on the back of the photo.

              There is no fee to renew the card.

              File it within 90-120 days prior your current EAD card expiration day.

              And you have to file it to

              USCIS Chicago Lockbox
              For U.S. Postal Service (USPS) First-Class and Priority Mail Express deliveries:

              USCIS
              Attn: FBAS
              P.O. Box 805887
              Chicago, IL 60680-4120

                    Sharing one more thing that is concerning me : I got feedback from my attorney like that:

                    If you decide to use me, the cost is: $350 attorney fee (and minor costs such as delivery/mailing charges) + $410 USCIS filing fee.

                    With your one-step application, there was no USCIS filing fee for your employment authorization application because USCIS does not charge for it for applicants for adjustment of status the first time around.

                      Ok, so I don't want to pretend to be more knowledgeable than your attorney. But, you should ask him/her why is that so?
                      One step application basically means that you filed I-485 and your spouse filed I-130 at the same time. Versus two step when your spouse files I-130 first, and then when you get that form received/ approved by uscis, you file I-485. You can find details on that here https://www.uscis.govhttps://www.imm...ive-us-citizen.

                      Then if you go to https://www.uscis.gov/i-765, and open Instructions for Form I-765 (PDF, 325 KB), where on page 10 you can find out that you are Adjustment Applicant or (c)(9). Then go to page 15 for "What is the filing fee?" where you can see who is not required to pay the $410 fee for the initial EAD, and (c)(9) applicants are NOT on that list. Which means that you (or your attorney) must've paid for that before. Scroll down to "Renewal EAD", and you can see there that (c)(9) applicants are not required to pay the fee. Talk to your lawyer, show him that document.

                      I think that you should only spend money on mailing it out and taking new pictures.

If you choose instead to file Form I-765 and/or Form I-131 separately after July 30, 2007, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of that you filed a Form I-485.

                            That's just confusing now... I found that in the instructions for I-485 too, but what I posted earlier was based on instructions for I-765...

                            The filing fee for Form I-765 is $410.

                              15. Current immigration status (visitor ,student etc).

                              For AOS what should be my current status? what you filled on that ?
