    Hi all,

    I'm a Canadian in US via a H1B visa and applying for adjustment of status by marriage through my husband who is a US citizen. We were pretty much ready to submit our package when we read the fine print in I-864 that says if you haven't filed taxes within the last 3 years, you must file and await for them to be processed, then request a transcript from the IRS that you can attach to your application. My husband failed to file US taxes for many years because we were living abroad (In Canada). We don't owe anything, we just failed to file them. The problem is that I've heard that this could be a 8-11 week process, plus another 1-2 week delay to request the transcripts. I have to leave my H1b sponsored job in December 2017, so we're trying to avoid delays as much as possible. What do you think is the better option: 1) File taxes for my husband, wait for the IRS tax transcript to arrive in (potentially) end-July-August, and then submit the package or 2) Submit the package now with personal documentation showing that they've been filed (turbo tax output), and hope all is well + request the IRS transcript in the interim so it's available for the interview. Any help would be appreciated!
