    Hi everyone,

    I would like to share my case, so maybe you can give me an advice. Here is goes:

    - I arrived in the US on a student visa refugee filed dor asylum the jugde has denied me
    - In the meantime, I started a relationship with my now wife in july 2016.
    - We got married in 2/6/2017.
    - We filed AOS(I-485) for me along with I-130, I-131, and I-765 on March 27th, 2017.
    - Case received by USCIS on March 29th, 2017.
    - We received the receipt numbers in the mail on April 9th, 2017.
    - Appointment for biometrics scheduled for April 25th,2017.
    But someone told me i should opena motion with the immigration court otherwise they will denied my case

    What do you think i can do ?

    Have you heard back after biometrics ? If there's no update, why would you go ahead to open motion with immigration court when they havent said anything? Wait to see what they say or want next then act. Do you have a lawyer?

            USCIS does not have jurisdiction to adjudicate an application for adjustment status for an alien subject to removal

            A good deportation lawyer working in the area you were deported would personally know the prosecuting attorneys, and will work with them to file a Joint Motion to Reopen. From that point forward it is pretty straightforward, both attorneys will propose to the court that you be granted relief from deportation as you are eligible for adjustment of status. You will probably then have to refile I-485 with the court (and pay the filing fee again).

            Fingers crossed that you can get this done as quickly and inexpensively as possible.

            I assume you entered with inspection

              Were you placed in removal proceedings after being denied entry on arrival? or did you enter as a student and then were placed in removal proceedings later for being out of status?
