    Hello,

    I have posted other threads but I have a question regarding the "priority date".

    Entered on a B1/B2 Visa 6/2001

    Married my husband 4/8/2017

    We are slowly getting to the start of the process: we are going to fill out the forms, I will get my I-693 form filled out by a surgeon and then we will see from there.

    We went to a free consultation and the forms they told us to fill out are: I-485, I-130, I-130A, I-131, I-765, I-864.

    We live together but we live with his parents. He has student loans to pay and we graduated from college a year ago (5/14/16). We have a joint checking account and two credit cards on us both. I have changed the mailing address on all bank and credit cards. Next we will put me under his auto insurance. We also combined out cell phone lines.

    Any other advice or tips will be helpful.

    But can someone explain the priority date? Is it like the deadline to fill out the forms and send them? Is it per month or per fiscal year?

    Forms received 6/4
    Received texts/e-mails 6/6
    PD 6/5 & 6/6
    NOA between 6/8 and 6/12 (I was out of town)
    Biometrics letter in mail 6/17 w/ 6/28 date
    SR 9/2
    Contacted Congressman 10/1
    Called the Congressman's office 10/10
    Interview letter 10/10
    Approval Letters for I-765 and I-131 10/16
    Received EAD/AP card 10/17
    Interview 11/8 RFE after
    New Card Being Produced 11/16
    Conditional GC received 11/24

    I am by no means an expert and recently filed AOS as the spouse of a US Citizen.

    Is your husband a US Citizen?

    If he is then your priority date is the date when Form I-130, Petition for Alien Relative was received by USCIS. This basically means a visa is immediately available to you as the spouse of a US citizen (pending approval of your case of course). The priority date will be the date that USCIS actually receive your package (your forms and fees)

    If he is not a US citizen then different rules apply you may have to wait until a Visa is available.
