  • Is my lawyer honest or lying to me?

    Lawyer filed for green card, aos, employment authorization-been 3 months haven't received anything since not even a receipt or email. I know that you're supposed to receive a a case number and a receipt but she said that it doesn't work this way and also said that I can't call to check the status because she did a lawyer agreement or something and that she represents us and they won't give out any information unless to her. Is this true? I'm getting suspicious. Please let me know and if she's lying, how do I deal with the situation?

    Yes you should have received a case number by now. Nope what the lawyer said is not true. You can always get info. regarding your case. USCIS would release info. either to you or to your lega representative viz., your lawyer.

      If you give her a check made out to USCIS for the filing fees, check with your bank to see if it has been cashed

      Either way I'd be inclined to report her to your state bar association

        Is there a way that I can check the status without a receipt number? How can I find out if she submitted anything?

          As Inadmissible suggested above, your best bet might be to contact your state bar association or AILA, and report your lawyer.

            Report her to the state bar, eg http://www.calbar.ca.gov/Attorneys/L...Complaint.aspx for theft

            File a police report for theft

            Go ahead and apply for the immigration benefits you are entitled to. You don't need an attorney to fill in your adjustment of status forms

              The minimum fee that you would have given the attorney for the USCIS fee should have been $1,225. If the attorney submitted this to USCIS in a timely manner, the attorney should have any or all of the following:

              1. Tracking number for postal service or courier service. The $6.50 Priority Mail fee, the easiest way to send packets to USCIS, would have had a tracking number.
              2. Up to three receipt numbers from USCIS, for I-485, I-765 and I-131. These would have reached the attorney by email and text (if he used form G-1145), followed by three hard copy receipt notices in the mail.

              If the attorney cannot provide any of the above, there is a high likelihood that the commingled your monies and has his own personal money problems.

              The Bar Association complaint should be done, but will take much longer than he needs to get your paperwork in the mail, up to several months for a Bar Associaton followup.

              A more businesslike procedure for you to follow is a clearly-stated written request for accounting of your monies and copies of any correspondence/receipts he has for your paperwork, giving him a reasonable time to reply to your request (maybe two weeks), else legal action will follow.

                Make sure it is the lawyer that you retained with whom you are communicating. It could be a paralegal or someone else in their office who isn't being helpful. Worst case scenario you may be the victim of a scam (not a lawyer, but visa services misrepresentation, in other words fraud).

                  How much did you pay her? She is certainly lying.

                  After they get your package they normally answer you within 10 days.

                  You don't have to hire an lawyer, you just have to read all the forms instructions and if you have any doubts this forum has great information.
