Hi,
I returned back to India last year and my I-485 in EB3 was pending since 2007. I've received RFE letter from USCIS on my and my wife's I-485 petitions. My attorney sent me the copy of RFE and says that I should respond to USCIS saying that I would like to withdraw my I-485 petition and that similar response to be sent by my wife to USCIS.
Basically, in the RFE, they requested for evidence if I maintained 'status' continuously from since the I-485 filing date of 2007 and till now. Also, they are asking for Medicals to be done again as the previous ones submitted in 2007 are expired long ago. Also, I transferred my H1 visa from the employer who filed GC for me to a new employer like 3 years ago. So, looking at all these, my Attorney advised me to respond to USCIS requesting them to withdraw my I-485 application that I filed when I was with my previous employer whom I left in 2010.
