  • I-864 if unemployed with $0 income?

    Hello,

    I am the petitioner, filing I-130&I-485 for my mom. I am unemployed, never worked in USA, but me and my husband are filing taxes jointly for the last 5 years. My husband is employed at the company with annual income and also he has his LLC from which he gets rental income. (He will file I-864a). How can I answer to the following questions:
    Part 6:
    2. My current individual annual income? (My answer is $0.00)
    18a Have you filed a Federal Income tax returns for the last 3 years? (My answer is YES)
    19a My total income most recent: ? (2016 My answer should be $0.00 or income on our joint tax return or N/A?)
    19b My total income 2nd most recent: ? (2015 My answer should be $0.00 or income on our joint tax return or N/A?)
    19c My total income 3rd most recent: ? (2014 My answer should be $0.00 or income on our joint tax return or N/A?)

    Yes. Note that your husband's info and income should be listed under Person 1 (Part 6 #3-5), and both of your incomes sum to the household income in Part 6 #15. Your husband will also need to fill out an I-864A to do this.

    It should be the exact number found on the "total income" line from your tax return for those years.
