Asylum Based i-485

  • Guys, I got my GC after getting my travel document, do you think I have to re-apply for i-131 again to get the re entry permit instead of refuge travel document ? Or I will be okey to travel with refugee travel document ?

      Once we get the Green Card based on Asylum. We are not eligible to use the re entry permit as we are not supposed to use our passport as we are stateless people.

      The only travel document we are supposed to use is the Refugee Travel Document until we get our U.S Passport.

      FYI If you want to apply for Travel Document, you need to pay the fee from your pocket. Earlier when our GC was pending, the Travel Document application fee was covered in that GC application.

          Yes, you can apply for re-entry permit since you have a GC now. I asked a lawyer about that. Just be aware that the fee for re-entry permit is way more expensive than for RTD but it does last two instead of one year.

            I believe reentry permit is for green card holders who are planning to leave US for more than 6 months.

                It’s okay if it’s valid, you can apply for the new one before 120 days of the expiration of the current one, the new one will be valid for 2 years

                    I got my GC in June and went to Europe 3 weeks ago with my passport from my original country. I had no problems nor issues at the airport. They did not even ask me anything. Once you get your GC, you are allowed to travel abroad everywhere else but your country.

                        It means USCIS is or about to processing your case and your security clearance expired. They need to order a new check and reused your previous biometrics to do so.
                        This is a very good sign and if the security check clears you can expect a RFE for updated/new medical exam within months.
                        In an unlikely event your case can also be transferred to field office for an interview

                          What if my national passport has expired? I can’t go back to my country and renew it as it is restricted. It’s very confusing what document an LPR based on asylum should use to travel abroad?
                          Refugee travel document is a joke. You only have 6 months not a year to travel with it, because everyone requires the passport to be valid for 6 months since the end of your trip. If anyone travelled with RTD which was valid less than 6 months???
                          Is it allowed to get a Reentry permit for LPR based on asylum? This seems to be the best option as it is valid for two years.

                            If your passport is expired you cannot travel abroad unless US and your destination accept the expired passport for humanitarian reasons, like Venezuelans can travel to a country that accepts the expired passport. Otherwise you would need to wait until you become US citizen and get the US passport.

                              • So, I decided to pull out all the numbers that represent the workload from the USCIS database (publicly available) and see how many asylum based i-485 cases both the TSC and the NSC have been receiving and adjudicating. Then I came up with the table below. Last column is the % of new cases received that were approved.

                                It is shocking to see how many fewer cases the TSC receives and works on compared to NSC. But I already knew that. What surprised me is that for the last two quarters that have the information available, both centers received very few new cases and seems to be trying to resolve the problem of the backlog. Actually for the last quarter, they received almost zero new applications. I am not sure why this happened. First thought was maybe the pandemic a year before that delayed many new asylum grants but the dates of the quarters are before the pandemic hit and the USCIS closed (in March 2020). So not sure why this happened.
