Asylum Based i-485

  • Nov 2013: applied for asylum
    Jan 2014: applied for U visa
    May 2017: U1 visa approved
    June 2018: Asylum approved
    Nov/15/ 2019: AOS (I-485 asylum based) application received (NSC #LIN...)
    Dec/17/2019: Fingerprints were taken and applied
    June/30/2020 : Case transfer to Local Office (but the website still shows Case Was Updated To Show Fingerprints Were Taken As of December 17, 2019, fingerprints ...)
    July/29/2020 : applied for I-602 (Application by Refugee for Waiver of Grounds of Excludability)
    August/31/2020/: fingerprints taken and applied for i-602 ( what is an odd fact is that the i-602 EOR has an SRC number and shows as I-485 also)..
    contacted Senator and Congressman (in LA, California) , Ombudsman ...
    November/24/2020 : congressman senator sent me a letter with a "According to the USCIS website processing times section, her case should take between 10.5 to 27.5 months from the date it was received by USCIS. .....case is well within normal processing times. Once USCIS is ready to interview her and an appointment becomes available we will notify via mail with an interview appointment notice."
    August 2021 interview notice
    September 2021 interview done
    SEPT 17TH 2021 (LA local office) Interview Was Completed And My Case Must Be Reviewed

        • Hello guys, the status of my case changed after 4 years and 7 months. The new status is “Request for Additional Evidence Was Sent” I hope it is for medical.
          Also, the status of my derivatives have also changed to “new card is being produced”. Their application was sent on May 2018.

          • This whole situation is absurd, we live here, we have already been interviewed, fingerprinted, and we still have to put our life on hold... waiting for someone to take a look at our file and decides to work on those 1000/200/100 pages ... or whatever ... it's just ridiculous. I wonder how difficult could be to just fill in some forms and just update a record on the system.
            We got asylum, it is our right to get a fair and fast-track immigration process. We cant travel because of the limitations on the RTD. what if we do international business?... what then?
            Do we just stop making a living then? we have been through enough. we shouldn't be reminded that we are not regular citizens... we should be able to integrate faster!!!!

                I dont think they would ever understand this.
                For them asylees are the least important category and they dunt give a damn about us

                      I agree with you. We can't join the Army. We can't open a business. We can't take the notary license. Can't register to vote. And we can't work for Federal Agencies. Although we work and pay taxes legally. Our hands are chained by USCIS because they didn't process our applications. This is so sad. I thought the new administration and new USCIS Director could do something to change but it seems to be hopeless. Once in a while, you see USCIS update their processing time to be longer, 10 months to 12 months, to 14 months,...to 43.5 months right now for the Green Card A05 category. National Benefit Center does not even show the processing time.

                      I'm following up with a group of asylees who got their Green card applications pending. Some people have been waiting for more than two years. We don't want to but I think at some points, we would have a class action lawsuit vs USCIS. Take them to the federal court and let's see why they have been neglecting us.

                        Have some heart of appreciation. Honestly, Asylee status is the de facto green card. 99.999% of you all are just fine and can open a business just fine.

                        Asylee / Refugee status is the most generous of all status other than LPR and USC and you are complaining. Makes no sense at all.

                        If you feel USCIS is doing something wrong, you can file a group lawsuit.

                          The limitation of RTD restricts us on travelling to foreign countries.

                          We can't open a business as one asylee in our group got an approved letter for franchising the 7-Eleven store, but can't proceed because he doesn't have a green card. How about that?

                          One more example of employment's struggle we face, here is his comment:

                          I'm working as a contractor for a company and recently company announced that all new employees and contractors should pass additional FBI checks, but this FBI check is only for green card holders or US citizens. (and I'm already one year as a contractor so company in near future planning to hire me to Full Time) ...So I contacted USCIS with a request to expedite i-485 as I need to have a green card to pass this check otherwise I will lose my job and it will cause financial loss for my family.
                          9/11 File expedite request over the phone
                          9/13 Got a request to provide additional evidence within 48 hours from this email
                          9/14 I sent them employment verification and page where it saying that only GC holders or US citizens pass this check, company cannot provide anything else something like we going to fire you if you do not pass it.... like this is an American company and for them, it's hard to understand how to deal with immigration ...
                          9/15 got denial with reason:
                          Good afternoon,
                          We received your response to our request for evidence of your extreme emergent need. Due to the high volume of expedite requests for this case type, we are strictly enforcing the criteria that has been set for these expedite requests. The evidence received does not satisfy the requirements for expedited processing. Therefore, your request for expedited processing has been denied.

                          This decision has no effect on the decision of your case. Your case is still pending adjudication.
                          We hope this information is helpful to you.

                            You can get licensed and become a notary public as an asylee. I did go through all the steps back in 2018. I have had no issues notarizing all kind of documents since then. I have also come across several business owners operating different businesses without a green card, some were asylees as well.

                            • Thats correct. I myself have few businesses. I have never had any problem buying or selling businesses.
                              Yes if you talking about some aecurity clearance jobs, then you do need a green card.
                              We are always complaining with what he have not got from this country yet but we forget what this country have given us so far. So rather than always complaining we should thank this country which gave us a better life.

                              • When you find something is seriously wrong and speak up, it does not make you ungrateful. And this my friend is what makes this country one of the greatest countries in the world.
                                Everybody has his own legit reasons to want the processing times to be reasonable and fair.
                                If anybody knows how to start a lawsuit let's connect and do it. It makes no sense to wait 3-4-5 years to get our applications processed.
