The federal law, REAL ID Act in this case, only specifies the "minimal" requirements, and the state have full authority under the constitution to require more documents and shorter validity period, than the federal law.

the state is under no obligation whatsoever to issue full term REAL ID to asylee, nor is your "document" carries any force to the local agency employee, because again, they are to follow local agency policies and state laws.

That being said, as part of the federal requirements, your document is not sufficient. You will need to present your EAD.

You can also reference to Ohio's document requirements here. https://publicsafety.ohio.gov/static/bmv2430.pdf

Once you get the right documents, they should issue you a real ID, though the validity period will vary depends on state laws.

Lastly, there is little use of Real ID, in my opinion, just use your passport if you need so.

And honestly, the Real ID implementation, in my opinion, is a total failure. Total, complete failure on all levels. The truth is, many if not a vast majority of states do not even verify the documents presented, other than those verifiable through SAVE. For example, birth certificate, US passport and US visas mot are not verified with issuer, this is direct violation of the Real ID Act itself, and created a large loophole for frauds.
The sassyness of yours answers... entertaining

    lol
anyways thats what i did , thats what i showed at the DMV and they gave me a real ID.
I certainly didnt know that whats federally considered a law or whatever wasnt sufficient at a state law level. but again. I only know what i have experienced . Talked to as upervisor showed her all the stuff she called homeland security or whatever and it was set and done.

You have the right to an unrestricted social security card and a full term Real ID (At least FEDERALLY) lol

      • Does anyone know of any action that perhaps will make them address all this backlog? I feel it is not a top priority for them currently. I wish that they would give us back all the waiting time.. as they should put on our green cards the date of the application.
I am waiting until January 17 (120 days after my interview ) if they don't give me an answer I would file mandamus

That said, you can file I90, and select 2.d. as the basis of filling. You need to attach your old card, an explanation of the error, and your derivative asylum approval I94.

You do not need to pay a filling fee and you will need to mail the application, instead of filling online (because you need to send in your card).

Also please do make a copy of your green card before submit it.
          Great! Thank you!

It was very much like a marriage interview, asked questions like; where did you we meet, when, who asked who out, who proposed to who, what we love about each other. They were very focused on documents with both of our names. We had; lease, bank statements, taxes, life insurance, dental, medical insurance, gas bill, phone bill, internet bill, gym membership… and the officer was still like “got anything else…?”

I have addressed this question multiple times.

You should keep writing to congress contact, the President and head of DHS/USCIS.

Also a class action lawsuit is the best option to force USCIS to make changes systematically.

That said, USCIS has shifted the processing of asylum based I-485 to field offices, it is expected those who used to fall under TSC will see much faster processing of their cases (in general).

As to your case, it's clear you either have grounds of inadmissibility that needs to be addressed / waved or you have an unresolved background checks. Mandamus may or may not work.

Please folks - stop asking meaningless questions like this.

Other's experience will not indicate how your case will go.

In general, USCIS interviews are fair and straightforward. As long as you have the evidence listed on the interview notice, and don't have national security / criminal issues, most folks get an approval at the end of the interview.

there is nothing to worry about.

If you have specific questions and concerns regarding your case, you should ask directly.

Poking other's cases will not help you in any positive ways, it's actually the opposite.

                    Dear Flando,
Will all due respect, I don’t think any question asked here is meaningless. We are all in this blog to help one another go through this painful process and I believe every single detail can serve as a relief or a support to someone. I also believe that we must respect everyone’s choices to ask questions and/or to respond or not. What X sees as meaningless can be important to Y. We cannot judge others based on our personal opinion in a public blog.

I don’t like to get into any arguments here. We are already going through a lot with USCIS And not in a mood for any trash talk.

We are so blessed to have immihelp platform to help each other and be a one family called ASYLEES FAMILY.

No one is obligated to answer the question (someone else).

There is a saying called “one person trash is another person treasure” which is self explanatory.

I feel like I may have put the question in a wrong and lengthy way and would like to apologize to @badbunny.

I just wanted to make sure onething that derivatives are being interviewed for I485 even after going through the interview at I730 (who are in the US) application.

Sorry I have put harsh words, and I apologize for that.

but my point is that you should ask questions like this, i.e. specific question you have regarding your situation.

That will help to provide you, and others, some guidance that might be useful. Otherwise you risk receiving information that will mislead you and others.

That being said, as of now the official position of USCIS is the spouse of asylum based I-485 does not need to come to the interview.

Of course, there might be exceptions, such as those never interviewed as part of the I730 process, or those filed I-485 together and are interviewed together.

The evidence to support my point is in the latest I485 interview notice, it specifically said -
"... For asylee and refugee Form I-485 applicants, your spouse does not need to come to the interview. ..."

Again, like I said, PLEASE, PLEASE, PLEASE FOLLOW INSTRUCTIONS ON YOUR INTERVIEW NOTICE.

                        • If anyone, whose case is being handled by National Benefit Center, had any action taken on their case or the case was transferred somewhere else please share. Even after calling USCIS I'm still confused with processing times and how the cases are handled at NBC. Thank you

NBC does not adjudicate any I-485 cases.

It's a prep and sorting center of AOS cases. It enters the information into the USCIS case management systems, get and store all your files (A files) for the AOS case, and ensure all documents such as required evidence and security screenings have been complete and in order.

If not they will issue RFE or RFIE to get the documents, and them compile them into your A file.

Once that is done, they will physically transfer all your files to a field office that has jurisdiction of your case, who will schedule your interview, if required.

I have no trouble sharing anything, since I’ve gone through this already. If it helps reduce some anxiety I’ll answer any questions.

I got derivative asylee status through I-730. I was interviewed for it and I was interviewed once again for the I-485. They were both very much like married based interviews. I was never on the principal asylum application.

                              • Has anyone had experience travelling internationally while the green card was pending with only a refugee travel document (RTD) and NO advance parole (AP)? Was there any issue coming back to the US or having your i485 application deemed abandoned?

My lawyer filed for AP when he filed the i-485 because he insisted I would need one but I heard from other sources (including other lawyers) that RTD is enough but wanted to see if anyone had a personal experience without problems. That AP is expired now and I really don't want to get a new one if I don't need it.

                                Thanks
