"If You Leave the United States While Your Application Is Pending

If you are applying for adjustment of status under INA section 245, and you travel anywhere outside the United States (including brief visits to Canada or Mexico) while your application is pending, USCIS will deny your Form I-485 unless:
    1. Before you leave the United States, you obtain a grant of advance parole by filing Form I-131, you depart and return to a U.S. port of entry while the Advance Parole Document is valid, and you are paroled into the United States upon your return; or
    2. You are an H, L, V, or K3/K4 nonimmigrant who is maintaining lawful nonimmigrant status and you return with a valid H, L, V, or K3/K4 nonimmigrant visa.

If you are applying for adjustment of status under INA section 209 because you were admitted as a refugee or granted asylum, you may travel abroad and return to the United States with a refugee travel document. You may obtain a refugee travel document by filing Form I-131 as specified in the Form I-131 Instructions. However, see Form I-131 Instructions for a travel warning regarding voluntary re-availment."

So, despite of implying that RTD is enough, the answer is still not clear that no AP is needed. Do you think I should email USCIS (never done that) seeking a clear, official answer in writing? If so, what email should I send to?

    Thanks
I have traveled while my AOS is pending, just use your RTD no problem .. I have been away for 3 months and it has been just fine.

When traveling to Canada by car, bus, train or boat (including cruise ship), you don’t need an eTA but you always need to carry proof of U.S. lawful permanent resident status

          • Hey Guys

So I got the letter today and apparently they have transferred my case back to NSC.

The reason they have stated is for faster processing.

            May 2018

            This is getting ridiculous.

Thank you for your reply GM1985 . I did not understand one thing; are you still outside the US? Or upon your return to the US, did you check and your AOS is still pending (not deemed abandoned)? Thanks

Sorry to hear that but it is at least a sign that they are working on your case. Do you think they will start transferring cases from Texas to Nebraska service center since the latter is much faster nowadays?

NSC and TSC have stopped getting new cases. All new cases will be sent to field offices.

They are now clearing the backlog, based on the latest data, NSC is almost cleared in terms of backlogs, and thus it is expected many cases will be transferred either to NSC or local offices (where an interview is needed).

that said, the question can be very misleading and should not be taken as an indication that YOUR case will be transferred or processed faster.

                      Hi Flando,

would you happen to have the newest data? Or is there way I can request it? As NSC seems to have 7000+ pending and 7000+ approved by end of June 2021.

It's in the link I provided (June 2021).

While you can request it generally they release every quarter, so next release would be around end of Dec.

NSC has < 10 new cases (as indicated by the "D") and TSC has 0 new cases.

they are clearing the backlog only.

This is another example of questions that cannot be answered.

Nobody will know how long it will take for YOUR case.

Most of the cases involving review take a long time.

While some resolve within days or weeks, most take months, and many, years to resolve.

It also depends on what is the issue with your case, is it expired security check (generally quick once the result has been updated and cleared), national security, terrorism or crime (long, and sometimes denial).

Generally in these cases you are subject to one or more inadmissibility grounds. Depends on what those are different levels of approvals are required. Might be field office or service center director. More serious ones must be approved by headquarters which is impossible "2 weeks max".

Please do not mislead people with such statement.

Also, even if 99.99% of the cases are processed within a timeframe, does not imply yours will be.

In summary, you might just need to relax and accept the realities that you won't heard back from the case, at a minimal, for moths. Only way to resolve is through a Mandamus case.

Of course, if the case resolves sooner than expected, you will be delighted. If not, no need to stress out, if you are clean, it will resolve eventually.

Will this data be published on the USCIS website? I am really keen to see the data from July 2021 to September 2021. It would give us a clearer picture of how fast they are clearing the backlogs.

I agree; probably, they will share it this Friday. And that can give us a clue how the process goes lately.
