there is a huge difference between an AP and RTD.

In law, when CBP officers inspect you under AP, you were "Paroled" into the US, this is where the name "Advanced Parole" comes in. You will NOT be ADMITTED as an asylee using AP.

I never claim you can never return, but what I sad is you risk the CBP mess up your status.

In law, if you ever face any inadmisibility grounds, you are no longer an asylee and USCIS can deport you without terminating your asylum status first. It's a big issue.

That said, most people won't face that because their adjustment of status case will be approved.

But what you said is very dangerous, even in case of your friend, for countries not accepting RTD s/he should still apply for it, and use it to return to the US. AP won't help her in any way travel abroad s/he still needs to use her passport. AP and RTD is only used when reentering the US in such cases.

Also - as i said countless times, your friend's experience does not apply for any other people. It's completely irresponsible to suggest so.

Lastly, here is what USCIS said -
    • Asylees (individuals who have been granted asylum) may travel abroad with the prior approval of the Secretary of the Department of Homeland Security (DHS). Such prior approval comes in the form of a refugee travel document.

I agree with you. I am curious. How do you know a lot? Were you working for USCIS before?

I had not worked for USCIS (yet).

Most of the time you can find answers by familiarizing with immigration laws, regulations and case laws.

While immigration itself can be confusing and complex at times, most applicants' cases are straightforward and there are patterns to follow.

        • Hello Experts,

I have got my GC finally - yay!

My parents are very ill in my home country and I wish to visit them.

Since getting a travel document takes 7 months on average, is it wise to get my home country passport and pay a visit? If I do visit my home country with my home country passport, what will be the consequences in the future? Such as US citizenship etc?

          Thanks.

I have talked about this topic countless times in this forum.

There is no issues whatsoever for you to travel using your passport, to any country, after you received LPR status. Period.

However, you do want to be mindful that your travel patterns should not conflict with your asylum case. i.e. if you claim your country's government put you on a control list, it's suspicious why they didn't detain you upon your return. However a LBTQ based individual should be mostly fine especially for a short visit.

            • I have a question,

My last update in my case is from January 25 when the case was transferred to a field office, since then they have sent me a request for I-693 and they have received it, but the website has not been updated; as the last update was 2 months ago, should I submit an e-request? or continue to wait? Thank you,

The 2 month you are talking about is not meaningful.

When is your I-693 being delivered to USCIS?

If more than 3 weeks passed I would suggest you call USCIS customer support.

I suppose you would have got the same format of letter what other people would have got it for I-693 medical.

If you read the RFE letter carefully, in the first page last para where it says you need to wait 60 days once they receive the RFE for the decision. If you don’t hear anything then you should call them.

Hey, my letter does not say any timeframe for them to make a decision, it only says that I have certain amount of time (until may 16) to submit the documents or the case will be denied. My I-693 was delivered to them last week.

                        Last week when?

You do want to contact USCIS around April 16 if USCIS website does not show RFE response received status.

This is to make sure they received it or you resubmit new ones before May 16 deadline and avoid a denial for RFE that is lost in transit.

They haven't, I submit an inquiry and they get back to me saying they are in a process of scheduling for an interview and I should hear back in the next 90 days. Not sure what question they will ask tho, not sure if they will ask the asylum interview question again.

Does anyone have experience with the green card interview?

No offense but not sure what you trying to get out of this question.

If you want meaningful advice you should clarify what additional documents they requested.

Generally speaking if you tell the truth and don't have serious defects in your case, an interview should not cause any concern. There is nothing to worry about.

Again, if you have special situations, you should state them.

Paralegal who filed for me i485 form made a bunch of mistakes. I received a letter with RFE stating that I need to explain why I answered those questions incorrectly and also they are asking to resend medical. So, my concern is that will I have an interview after and if so, how the interview usually goes.

what kind of mistakes they made and what exactly they asked for clarifications? you can provide the details here as long as there is no personal information.

Just to be very clear, you, the applicant, are FULLY responsible for each and every answers in your submitted form(s). Period.

Paralegal mistakes is not an excuse. YOU SHOULD ALWAYS CHECK EVERY ANSWER BEFORE YOU SIGN IMMIGRATION FORMS.

That said, you should for sure explain in your RFE about the mistakes and why you didn't catch them. be honest and provide as much details as you can.

You can never predict what will happen in the interview, or whether there will be one at all. However, my suggestion is you get a competent lawyer to accompany you and answer their questions with honesty. As long as you do that, you will have the best chance of getting the case approved.
