Asylum Based i-485

  • I know this has been discussed here multiple times but I figured I’d ask again ( maybe something’s changed?! Also would be a good refresher for the new readers)
    so my questions is : if a green card holder ( asylum based) needs to travel to a third country ( not country of origin) but due to delayed RTD (travel document) has to use current passport , would he / she face any negative consequences upon returning back to US or anytime in future (for example when applying for naturalization) ? If yes, what kind of consequences those might be ? I lean towards this being not a problem, but would appreciate if people here could share their opinions/ experiences about this! Thank you.

    • IT'S HAPPENING!!!!

      I woke up on Saturday to the news that an action had been taken on my case. It's a Request for Additional Evidence, probably the medical exams (I sent mine with the application). This means my case has finally been adjudicated to an immigration officer, and I'm so happy! I almost couldn't believe it, as I've been waiting since September 2019.

      This might be just a coincidence, but I contacted my congressman on April and received a reply on June, saying how USCIS was aware of the "delay" and that my case was pending adjudication to an officer. If you haven't done this I recommend doing so, it's free, you have nothing to lose, and if it doesn't help it won't hurt your case either.

      Will keep updating this timeline:

      September 12, 2019 We accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or Adjust Status. Our Texas Service Center location is working on your case.
      February 27, 2020 The fingerprints relating to your Form I-485 Application to Register Permanent Residence or Adjust Status, were taken.
      January 21, 2022 Your Form I-485, Application to Register Permanent Residence or Adjust Status, was transferred to another office for processing.
      January 25, 2022 We transferred your Form I-485, Application to Register Permanent Residence or Adjust Status, to another USCIS office that now has jurisdiction over your case.
      July 16, 2022 Request for Additional Evidence Was Sent

      I also noticed in case tracker that a lot of neighboring cases got some movement, whether is RFE or approval. For reference, I'm in FL. There is hope folks!!!!!!

      • Hello, guys. My permanent resident application (form I-485) has been transferred to an asylum office. I would like to share with you my timeline. Hope it will help to somebody in same situation.

        My timeline:
        January 3, 2018 - Asylum case approved
        August 8, 2018 - filled asylum based form I-485
        February 21, 2019 - Case been transferred to an Asylum Office
        March 21, 2020 - Asylum office has completed all action on your case. Contac the Los Angeles USCIS Office for a status update on your Form I-485
        February 24, 2022 - Case was transferred and a new office has jurisdiction. Transferred to National Benefit Center.
        May 3, 2022 - Case is ready to be scheduled for an interview. As of May 3, 2022, we are ready to schedule your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number LIN…., for an interview. We will schedule your interview and send you a notice.
        May 20, 2022 - Interview scheduled
        July 7, 2022 - Interview in USCIS Los Angeles field office
        July 15, 2022 - I-485 was Approved and new card has been produced
        July 19, 2022 - we mailed your new card for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number LIN0000000000, to the address you gave us.

          Does anybody knows what's the timeline for NBC? My application has been on fingerprints taken since may 2021.

            it's irrelevant. nobody knows when your case will be processed.

            But as you can see someone just posted before you, the less you worry about it the better. I'm sure one day you woke up your case will be processed.

            that day will come soon.

            Sit tight and wait.

                Nothing is gonna help you other than file a lawsuit or wait.

                Absent of inadmissibility issues you should expect a decision shortly.

                You will get nothing but frustration by posting and thinking like this.

                Just forget about it and go on with your good life. You will be delighted.

                  I have a question. I can see that you have been very active here in the last several months. And the main point that you recommend to everyone here - is to "Sit tight and wait."

                  Are you a USCIS worker who needs to calm down everyone here to have fewer court cases against bureaucracy in a system, or are you a person who is looking for help?

                  • Hi. I have my green card and valid refugee travel document (RTD). I plan to visit Canada and enter by air and I am wondering if anyone had a recent experience flying to Canada with their green card and RTD only. Do I need to apply for an eTA? Thanks

                      I cannot tell you that but I'm just stating a fact.

                      You constantly worry and complain about delays will do aboustely nothing and it actually harm your health and make the wait even worse.

                      Clearly from the recent trend you can see that the cases are moving.

                      Like I said, you have basically two choices (generally speaking) -

                      1. Sue DHS;

                      2. Wait.

                      I'm pretty confident if you wait patiently, your cases will be processed soon within the next 6-12 months.

                      Forget about it and time will go much faster.

                      Also if you have any specific case / law related questions, feel free to ask. But my point is complain about delay will do nothing to help anyone.

                        First of all, I waited for 43 months after I wrote my first post without any complaints. I just shared my story.

                        Please don’t worry about my health and the way I am spending my personal life. It is not your business, especially when we are not wearing the same shoes and you have NO Idea what WE are ALL going threw.
                        I decided to join this forum to talk with people who feel vulnerable, hurt, or upset with a system that doesn’t work right.

I can CLEARLY see that I paid thousands of dollars, survived in a new country, here for almost ten years, and CLEARLY feeling frustration, pain, and many other emotions that you can’t relate to. CLEARLY - is not a word that we can use at all in this topic

                        Sue - amazing advice to all of us. Can we have more info about this process? - How to sue DHS? If you know - please share/ Maybe you know statistics, maybe you know good lowers who know how to write proper mandamus? Where is this information? We only get you your second point

                        When I applied a year ago to see my sister wedding in September, it took 12 months for USCIS to reprint my document.
                        Now it takes 12,5 months (extra two weeks) TO PRINT AGAIN what I already had!!!!!
                        On top of that - if you want to apply again - you need to submit your travel document!
                        But if you submit your travel document - you don’t have it for more than a year!
                        Talk to your co-workers and tell me to WAIT again!
                        And thank them for me not seeing my family even in a third-party country!
                        Because it takes them 12,5 months to press PRINT! (I had the same document before!)

                          Well, sorry to hear that.

                          but it's also amazing to me how people shows zero token of appreciation and get lost in the fact that you are currently enjoying one of the best immigration status in the US (next only to LPR). Pretty much other than international travel, you have a de facto LPR status.

                          Now that you have asked, I do see a need to tell that I go through F1, H1b, employment based green card as well as the whole asylum process that took years if not decades.

                          I would say I waited longer than most of the folks here and I have "suffered" much more than many of you have endured within the US and outside, though I'm lucky enough to not having any security concerns that delays the case, among other privileges I have enjoyed.

                          Of course it's your personal life, do whatever with it. However I do not recommend you complain here as the negativity will influence others who are waiting and will not change a thing.

                          Also - if you want to sue, ask an attorney. You just need to pay the fee to shorten your pain. If that's what you desire, do it. Otherwise, no choice but to wait.

                          Lastly, each case is different. A very small percentage of all cases get delayed pretty bad, normally those that's pending security or other clearance. Besides those, if you browse this forum, you will see plenty of old cases moving to local office and being addressed right now.

                            That sucks. Mine is also stuck in the same queue as yours, though I don't have a particular need to have one and applied just to get a feel for how things are nowadays.

                            However you have to understand that USCIS is currently prioritizing its resources to process more pressing cases, such as AOS, family, asylum and employment based (before numbers run out in this FY), EADs, etc. Travel document is not something of a particular critical benefits that USCIS need to act immediately..

                            There are couple of options if you get stuck in this:

                            1. defer travel, if it's vacation or leisure;

                            2. You don't have to send in your old RTD when you apply for new ones. According to the procedure, USCIS will issue RFE when they are ready to adjudicate https://www.uscis.gov/sites/default/files/document/policy-manual-afm/afm53-external.pdf

                            3. If you face urgent need, such as medical emergency or urgent business need, you can request expedited processing using things like letters from employer.

                              Flando, you don’t have to go under every message saying wait wait, this and that. How about you just let people vent? No one assigned you the class captain here to police or keep everyone in line or should we all leave you here and go form another group? Sometimes ppl know their questions have no answers, that their venting won’t help but they do it anyway cos somehow it helps them feel better, especially when they read messages from other ppl who are in the same boat as them, but because you, I guess ppl are too scared to express themselves here now and that’s not cool. Leave ppl alone to vent, if they ask questions you think you have answers to, answer the question and leave it at that, stop taking away the only thing they have in this situation which is complaining, venting cos no one really really wants to sue uscis and everyone is already waiting, there’s no need telling them to wait. No one put you in charge. Let ppl be.

                              • Hey there, would appreciate it if anyone could share experience traveling to a third country ( not country of origin ) with a green card ( obtained through asylum) and the original passport? I've been waiting for my RTD since last year but have to travel urgently for educational purposes for a few months, I still have my old passport which is valid, so I was wondering if I am allowed to use it to travel or not? What could be potentially negative consequences of doing that ? Any advice will be highly appreciated, thanks in advace !!
