Asylum Based i-485

USCIS received my RFE about 8 months ago and still they haven’t made a decision. Field office is Miami Florida.

crazy thing is that I’ve seen rfe from Miami get approved in just one month or even 2. anyone experiencing this ?

this is exactly why I repeated so many times and some one complained, but I would say it again, don't look at other people's cases. It won't help you in any way.

You got worried if your case is not being processed as fast as others'.

Each case is different. There is nothing you can do. RFE generally a good sign, so just wait.

I am sorry to hear that, and I have never heard of a case taking over 20 years wow. I hope someone will help you with that, but seriously if I were you, I would just hire an attorney for that.

Thanks for your concerns, I have hired several attorneys in this 30 year journey, some times USCIS complicates a case by their own mistake/s and gets hard headed to solve it. Unfortunately I just got sucked in the pipeline now I have to wait indefinitely, the damages are countless due to this. The attorney is advising to wait until I receive something from USCIS, mandamus is not advisable due to the risk of denials since USCIS has denied numerous mandamus cases on asylum based i485, Thanks again for your interest.

They asked me to send proof that I was still single which I think was very weird and highly unnecessary . It has now cost me 8 months of no activity on my case.

That's very interesting, as your marital status, specifically being single and not sponsor anyone in your application, has little value to the case in most situations as you said.

i received RFE for medical last week for my pending i485 ( asylum based). Do i send Original RFE letter back with my medical or a copy of RFE letter and medical back to USCIS?

Make a copy for your self and send in the original on top of your medical envelope.

They didn’t give a reason they just asked for that pointing that it was needed for them to make a decision and it’s been so long now and they haven’t made a decision.

11/2020 i485 application was received (NBC)
01/2021 fingerprint was taken

no movement for 2 years

01/2023 finally decided to file mandamus
notice served to us attorneys and after 2 weeks received rfe on 01/17/23.

What does it mean when the USCIS tracker says ‘service request was completed’ but I haven’t received any update on email or post office from them? Been waiting since April 2018.

Important Update From USCIS -

USCIS has updated its policy today that could, in theory, enable early filling of I-485 for asylees.

The calculation of the 1 year physical presence requirement has been modified to be based on the time of adjudication.

That means you can file for AOS before the 1 year anniversary date.

Though it remains unclear how USCIS would handle cases where when they are ready to adjudicate the candidate does not meet the 1 year presence requirement.

Since 2012 USCIS on line status update case search informed that my request for evidence was received on (date 2012) we are actively processing your case, even after interview notice nothing changed and it informed the same thing but after almost 11 years yesterday my case search changed "Your case status is unavailable at this time. We are working to get you accurate information as soon as possible". I am so puzzled if this is a good sign or USCIS is still disappointing in my case as always.

Seems to be a system glitch.

That said, you should be able to find out after a day or two. If I were you, I would have sued USCIS / DHS.

Thanks buddy, my lawyer says we have to wait for exemption authority, some guys in my situation sued with mandamus law suit and USCIS gave decisions with denials saying there is no exemption authority for your group so wait until exemption or we are compelled to deny until secretary of state and attorney general office does not issue DHS with your exemption. I told my attorney that I have no link with the group they connected me and she said you can tell them in the interview so I did but I.O. didn't say a word in regards to the wrong group. If a case is on hold based on 212a3b of ina it is hard to fight with mandamus law suit. There were about 3000 hold cases in 2022 there were I believe 16000 in 2008 and I am unfortunately one of them.
