  • [QUOTE=Jeor11;n745399]Hello Sahiaman

the Travel is not for my country of origin. I don’t plan to travel there. It is to another country. But the question is if I can use my passport of country of origin ?

Here i have an information for your question hope this help
[/Asylees should understand, however, that even after obtaining legal permanent residence, they will have to use a Refugee Travel Document to travel abroad. It is only after an asylee becomes a U.S. citizen that he will be eligible for a U.S. passport. Asylees should also understand that until they obtain U.S. citizenship they cannot travel back to their countries. When they apply to naturalize, they will have to list all international travel after obtaining legal permanent residence in the United States, and a DHS Official could re-open the asylum grant upon learning that the applicant traveled back to his country.

I have GC, EAD, Travel Doc pending.... so I check every week.

so far every couple of months they increase processing time on website
Actually according to data from USCIS is shorter for GC.
GC inquiry date moved forward about one and half month from March 2018 to late May 2018.
But it is still too far from now. so it is quite meanless.

But its very much advisable that u apply for a travel document that way u wont any problems wen u apply for Naturalization and also keep the record of the places u visited like hotel bills and all u save those records in case they ask. And try not to make long absences from USA becoz ur presence counts towards ur days for naturalization. This is all i knw. I hope that helps but short trip anywhere abroad wont harm ????
        I agree !

Don't use your country of origin passport.... using that passport means you are getting benefit from that country's government and you are under their protection as their citizen while traveling. That will be questionable.

The best is to wait to get US Refugee Travel Document and travel with that. I understand some countries don't accept RTD but it is what it is. I would never dare to use my original passport because I want all clear unquestionable travel for when I come back to US or for when I apply for citizenship in future .

        • I have an interesting consideration on date of GC since.
As known to all, we could apply for GC after 365 days granted asylum.
When GC has been approval, resident date will roll back to 1 year.
If approval today(10/19/2020), GC card will note since 10/19/2019.
But has one problem, if somebody granted asylum after he entered US 2 months. the since date will be less than 365 days from he entered US.
For example, Mr. A arrived in US on 12/01/2019, then he granted asylum in 02/01/2020. So he could file I-485 on 02/01/2021.
If his case could be processed in normal speed, then he may get approval in 08/2021.
His GC will note reside since 08/2020.But obviously 08/2020 will be about 8 months after he entered US.
My consideration is: will this case delay his GC application? will his case be pending until 12/2021 to be approval?
Is it a rule that permanent residence start after 1 year in US?

Yes it has to be technically a complete one year after the asylum approval thats the clock starts after u are approved asylum. ????????

even tho it’s very unlikely he gets approved in 6 months but even so I don’t see any issue with it , because the one year wait is when you APPLY for GC.

Nowhere mentions the time you enter US till your “resident since” date matters at all.

My personal opinion is that it doesn’t matter.

The since date on asylee GC must be late than the day you granted asylum.
the days before asylum approval is not counted in residence because at that time it is not asylee status. That is pretty certain.

                      It is completely NOT TRUE

According to BIA and 4th circuit court, you CAN definitely travel with your country's passport without negative consequences.

"As the Fourth Circuit noted, an asylee who adjusts status under section 209(b) obtains significant benefits, including “a direct path to naturalized citizenship,” a better chance for his or her family to obtain lawful permanent residence, and “the right to travel outside of the United States without the advance permission of a refugee travel document.”

This is from BIA decision Matter of N-A-I-.

BIA's decisions are binding for USCIS. It is simply untrue that USCIS can deny or harness you in your naturalization simply because you traveled using your country's passport AFTER you got your green card. Note you should not travel with the passport BEFORE you adjust your status.
