Asylum Based i-485

  • Hi. My RFE finally arrived and it is for medical. But the weird thing is that the medical form that was sent is dated of June 2020 so not expired yet.

    USCIS states in the letter that the vaccination record completed by a designated civil surgeon was submitted but the civil surgeon failed to complete the medical examination (Form I-693).

    But, by the time it was done two years ago, the civil surgeon gave a copy of the sealed version of the form to me and it was complete, stamped and signed. So I think there is a mistake.

    I do not know what to do, should I contact the USCIS or just get another consultation?

      Just to be very clear, you, the applicant, are FULLY responsible for each and every answers in your submitted form(s). Period.

      Paralegal mistakes is not an excuse. YOU SHOULD ALWAYS CHECK EVERY ANSWER BEFORE YOU SIGN IMMIGRATION FORMS.

      That said, you should for sure explain in your RFE about the mistakes and why you didn't catch them. be honest and provide as much details as you can.

      You can never predict what will happen in the interview, or whether there will be one at all. However, my suggestion is you get a competent lawyer to accompany you and answer their questions with honesty. As long as you do that, you will have the best chance of getting the case approved.
      I prefer not to, there is personal information.
      I know it was my mistake.
      I already hired a lawyer, will see what happens.

        as I asked before , My asylum based I-485 is in processing
        i also applied for RTD At a time but got AP Instead , i called USCIS Several times that i need RTD
        They keep saying they are the same
        i need to travel to turkey not really sure if AP Is safe
        my first RTD Will expire on may 6

        • Hello friends finally good news . My card is being produced…
          here is my timeline….
          august 10,2018 applied permanent resident card in Nebraska center.
          october 16,2018 my case was transferred to texas service center
          february 1,2022 request for initial evidence was sent
          march 3,2022 evidence was received by uscis
          march 23,2022 new card being produced.
          I have been following this forum from last 3 years and it helps a lot with some immigration knowledge

              and you get granted asylum from ij or asylum officer?

                  They are NOT the same. I would consult with an attorney on how to return it and request the right document. You might have to pay again. You may have to postpone your trip to Turkey. Do not try to re-enter the US with AP if you have refugee status. How you present yourself at an entry point and what document does matter based on what status you hold. If you are a refugee, you MUST enter the US with an RTD.

                    • After wait of 28 months I have a good news, my I485 is approved today and here are the timelines

                      December 2019 We received your Form I-485, Application to Register Permanent Residence or Adjust Status at TSC
                      December 2019 The fingerprints relating to your Form I-485 Application to Register Permanent Residence or Adjust Status, were taken.
                      February 2022 We sent a request for additional evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status.
                      March 2022 We received your response for Form I-485, Application to Register Permanent Residence or Adjust Status.
                      March 2022 We ordered your new card.
                      March 25, 2022 Case Was Approved
                      Expecting Green Card in hand by next week.

                      I hope everyone get their good news soon. God help us all!

                              You do not seem to get it.

                              My suggestion is you just go ahead and do a new I-693. DO NOT CONTACT USCIS AND TRY TO ARGUE.

                              DO NOT DO THAT. DO NOT DO THAT. DO NOT DO THAT.

                              While it might cost you some money to repeat the medical exam, it's just well worth it to be able to respond quickly and get your GC.

                              Most likely either your physician did not complete the form properly, or USCIS lost part of the file.

                              Not sure if you know what to look for in I-693, there are plenty of places where the physician can make a mistake. If that is the case, I would go back to your physician and ask them for a new form because they made a mistake. If they refuse, just don't bother and go to another physician and get a new one.

                              If they did not make mistake, you still should just go and get a new one.

                                Hello WaitingGC,

                                It looks like the issue was with Civil Surgeon.

                                I think you should reach out to Surgeon who did your I693 and show him the letter and see what he/she has to say.

                                I guess you can’t do anything at this time. It’s the Civil Surgeon(CS) who should be responding to this RFE request by USCIS.

                                I am positive that CS will know what he/she missed in the last I693 form and will give you a new completed I693 form which you can send it to USCIS once it is ready.
