    Hello,
    I am so excited to learn that I received an email from USCIS stating we are scheduled for the interview on June 22nd. Here is our timeline.
    PD- 8/19/16
    EAD- 10/16
    Interview scheduled -6/22/17

    I have a question. I am the petioner filing for my husband. I have a part time job where I make over 18,000 a year. I will be starting my second job which will bring in additional income starting in June before the interview will this be an issue at the interview? I would appreciate your take.

    I would advice you to get a co-sponsor. $18.00 a year is below the poverty guidelines required by USCIS. Your new job may help, but these guys just look for any loophole to deny people.

      Thank you Aquila for your response and you are correct in that we may get denied for something that could have been avoided from the start. It's better to be safe than sorry.

      Anyway, can you tell me which form I should use for the co-sponsor?

        Disregard my previous post as I see that form 864 should be used for the co-sponsor.

          I may be wrong, but this may be where the confusion lies. I believe you still fill out the form I-864, even if the funds are not enough. Then you find someone who could be a co-sponsor to help you meet the requirements.

          Hopefully someone who know more will help you with this.

            I did complete i864 and my salary met the poverty guidelines of 2016. At that time, I had two jobs. Now, I only have one job which does not meet the poverty guidelines and that is the reason why we need a joint sponsor.

                Did you attach your latest tax return to i-864? did it meet poverty guidelines? Did your spouse get a EAD? Does the spouse work? if Spouse works then their pay can be used to boost the household income. If you meet income requirement on last tax return i doubt they will ask about current income. If you dont meet povery guidelines you will get an RFE to submit a new i-864 with a co-sponsor.

                  Yes, tax return was attached for 2015 and guidelines were met. Income was not met for 2016 (sorry got my tax years mixed up earlier). So, joint sponsor is needed. Spouse has EAD. Spouse has job and he makes over the poverty guidelines.

                    Then you household income is above the poverty level and you will not need joint sponsor. You spouses income counts too.

                        Just make a new i-864 and add your spouses income to part 6 as person one. You need to attach employment letter, W2 if you have any and recent pay stubs. Good luck with you interview.
